No.Condition Text
.In order for such a proposal to be granted Prior Approval, it is necessary that no development has taken place until the determination has been made. Significant works have commenced and therefore does not comply with Paragraph W(3), and is a breach of Condition G.1(d) of Part 3, Schedule 2, to the Town and Country Planning (General Permitted Development Development) (England) Order 2015 (as amended).
.In order for such a proposal to be granted Prior Approval, it is necessary that where the development consists of a change of use of any building with a display window at ground floor level, the ground floor must not be used in whole or in part as a flat. Insufficient information has been submitted to demonstrate the use of the two stores indicated on the plan as it appears that it could be associated with the flat. As a result, the proposal fails to comply with Condition G.1(b) of Part 3, Schedule 2, to the Town and Country Planning (General Permitted Development Development) (England) Order 2015 (as amended).
.In order for such a proposal to be granted Prior Approval, it is necessary that there is provision of adequate natural light in all habitable rooms of the dwellinghouse. Whilst the proposal indicates the insertion of windows on the principal elevation and a further window has been inserted on the side elevation (not indicated on the plans), Class G only allows the change of use of the building, it does not permit any external alterations. As a result, the proposal fails to comply with Condition G.1(d)(iv) of Part 3, Schedule 2, to the Town and Country Planning (General Permitted Development Development) (England) Order 2015 (as amended).
.In order for such a proposal to be granted Prior Approval, it is necessary that arrangements required for the storage and management of domestic waste is submitted. Insufficient information has been submitted regarding this provision, which is stated to be located within the building, to ensure that odorous impacts and potential fire hazards are addressed. As a result, the proposal fails to comply with Condition G.1(d)(v) of Part 3, Schedule 2, to the Town and Country Planning (General Permitted Development Development) (England) Order 2015 (as amended).
.The site is located within the Orange 400m to 2.5km Indicative Habitats Impact Zone and the prior approval application proposes the net increase of one dwelling. As such a shadow template Habitat Regulation Assessment is required. This has not been received nor has the required £185.93 Green Infrastructure and Recreational Avoidance Mitigation Strategy payment been made to the Local Planning Authority. The proposal therefore does not satisfy criteria 9 and 10 of Part W of the Town and Country Planning (General Permitted Development Development) (England) Order 2015 (as amended).
