No.Condition Text
.The development must be begun not later than three years beginning with the date of this permission. Reason: The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
.Other than where stated by other conditions of this planning permission, the development hereby permitted shall be carried out in accordance with the application form and following approved plans and documents: - 8352 - P01B Location Plan and Block Plan - 8352 - P02A Proposed Site plan of driving range and access - 8352 - P03A Proposed plan, elevations and section A-A of new driving range - Ecological Report re: 2022/184.1 dated 28/03/2023 - Flood Risk Assessment ref: 3016/RE/08-22/01 dated August 2022. Reason: For the avoidance of doubt.
.There shall be no installation of any fences or screens withing the development, nor shall there be any use of the development hereby permitted, until full details of the surrounding fences and gates to be installed around and within the application site have first been submitted to and approved in writing by the Local Planning Authority. The details are required notwithstanding any notation of proposed fences indicated on the approved plans. The submitted scheme shall include details evidencing the appropriateness of the proposed fence height(s) in the interests of safety, and shall include elevational details and colours (RAL numbers). The information to be submitted shall also provide details justifying the fence height and designs in the interests of safety and visual impacts. The fences shall thereafter be erected in accordance with the approved details prior to the first use of the driving range. Reason: The condition is necessary because of the discrepancy in the information provided in the application and the approved plans, and details are required to ensure the fences are of a height suitable to stop golf balls leaving the site and to ensure they are a suitable finish and of minimal impact on the surroundings, in accordance with adopted policies CS09, CS11 and CS16 of the Great Yarmouth Core Strategy (2015) and policies GY8 and E4 of the Great Yarmouth Local Plan Part 2 (2021).
.Prior to the first use of the building hereby approved a scheme of planting to the western boundary of the site shall be submitted to and approved by the Local Planning Authority. All planting, seeding or turfing comprised in the approved details shall be carried out in the first planting and seeding season following the first use of the driving range building hereby approved, and any trees or plants which within a period of 5 years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless the Local Planning Authority gives written consent to any variation. Reason: In the interests of the visual amenities of the locality and to provide biodiversity enhancements, in accordance with adopted policies CS09, and CS11 of the Great Yarmouth Core Strategy (2015) and policies GY8 and E4 of the Great Yarmouth Local Plan Part 2 (2021).
.This permission does not include any approval of floodlighting whatsoever. Any proposed floodlighting shall first require the express written permission of the Local Planning Authority, whether as stand-alone lighting columns, mobile lighting installations or as fixtures attached to any perimeter fencing. No external lighting proposed to the building shall be erected whatsoever until a scheme detailing the type, strength, angle and position of any light is first submitted to and approved in writing by the Local Planning Authority. The lighting shall thereafter be erected only in accordance with the approved details. No additional lighting shall be erected other than in accordance with the approved details. Reason: Floodlighting of the driving range area has not been proposed in this application and it is noted that the previous permission considered only lighting to the building. Details of lighting must be agreed to minimise impacts on the surrounding area, the landscape setting and the potential disturbance to amenity and ecological habitats or bat feeding corridors, and to ensure no significant adverse impact is caused to the public highway or the surrounding area, in accordance with adopted policies CS09, CS11 and CS16 of the Great Yarmouth Core Strategy (2015) and policies A1 and E4 of the Great Yarmouth Local Plan Part 2 (2021).
.There shall be no commencement of the development hereby permitted until precise details of all the proposed materials to be used on all aspects of the approved driving range building have first been submitted to and approved in writing by the Local Planning Authority. Notwithstanding the information presented on the approved plans, the permission hereby granted does not grant approval to the materials indicated on the approved drawings. The details to be supplied shall be reconsidered in light of the building's increased height and amended design and consequent increased prominence in the landscape and surroundings, and a revised materials schedule shall be presented with a demonstration that the palette of materials chosen has appropriate regard to the context in which it is proposed. The development shall thereafter be constructed in full accordance with the approved materials schedule. Reason: In the interests of visual amenity and minimising the impacts on the landscape and setting of the development, given the buildings increased prominence and lack of contextual appraisal in the documents submitted with the application, to accord with adopted policies CS09 and CS11 of the Great Yarmouth Core Strategy (2015) and policies E4 and GY8 of the Great Yarmouth Local Plan Part 2 (2021).
.There shall be no commencement of the development hereby permitted until a Biodiversity Method Statement has first been submitted to and approved in writing by the Local Planning Authority. The content of the method statement should include: - Purpose and objectives for the proposed works, - Detailed designs and/or working methods necessary to achieve the stated objectives. - Extent and location of proposed works shown on appropriate scale maps and plans, - Timetable for implementation, demonstrating that works are aligned to the proposed phasing of construction, - Persons responsible for implementation of the works, - Initial aftercare and long-term maintenance (where relevant), and, - Disposal of any wastes arising from works. The works shall thereafter be carried out strictly in accordance with the approved details and shall be retained in that manner thereafter. Reason: In the interests of protecting and promoting biodiversity and minimising the impacts on adjoining wildlife sites, in accordance with adopted policies CS11 of the Great Yarmouth Core Strategy (2015) and policy E4 of the Great Yarmouth Local Plan Part 2 (2021).
.There shall be no use of any part of the development hereby approved until a written scheme of detailed specifications, design and installation proposals for providing electric vehicle charging within the car park has first been submitted to and approved in writing by the Local Planning Authority. The development shall be constructed to incorporate those details which shall be made operational and available for use prior to the first use of the development and shall be retained as such thereafter. Reason: In the interests of promoting sustainable development in accordance with adopted policy I1 of the Great Yarmouth Local Plan Part 2 (2021).
.There shall be no commencement of the development hereby permitted until precise details of the proposed means of providing foul drainage for the development have first been submitted to and approved in writing by the Local Planning Authority. The development shall thereafter be constructed in accordance with those details and operated as such thereafter. Reason: In the interests of protecting adjacent sensitive ecological sites and due to the application form and supporting information being contradictory in this regard and requiring clarification, to accord with adopted policies CS09 and CS11 of the Great Yarmouth Core Strategy (2015) and policies GSP5, E1, E6, I3 and GY8 of the Great Yarmouth Local Plan Part 2 (2021).
.There shall be no commencement of the development hereby permitted until precise details of the proposed means of providing surface water drainage for the car park and the building within the development have first been submitted to and approved in writing by the Local Planning Authority. The information to be provided shall include, where soakaways or infiltration is proposed, full details of ground investigations and infiltration testing, and where not possible or feasible, evidence that this cannot be pursued, along with full details of alternative means of drainage. The development shall thereafter be constructed in accordance with the approved details and shall be operated as such thereafter. Reason: In the interests of protecting adjacent sensitive ecological sites and due to the application form and supporting information being contradictory in this regard and requiring clarification, to accord with adopted policies CS09 and CS11 of the Great Yarmouth Core Strategy (2015) and policies GSP5, E1, E6 and GY8 of the Great Yarmouth Local Plan Part 2 (2021).
.There shall be no use of the development hereby permitted outside the hours between dawn to dusk on any day. Reason: No information has been provided in respect of the proposed opening hours, and there are no details of proposed lighting within the development, so the restriction is imposed to ensure that any use is only accompanied by additional lighting details and associated mitigation in the interests of minimising the impacts on designated ecological sites and the surrounding area visual and residential amenity, in accordance with adopted policies CS09 and CS11 of the Great Yarmouth Core Strategy (2015) and policies GSP5, A1, E4 and GY8 of the Great Yarmouth Local Plan Part 2 (2021).
.There shall be no use of any part of the development hereby approved until a Flood Warning and Evacuation Plan has first been submitted to and approved in writing by the Local Planning Authority. The Plan shall include sufficient evidence to demonstrate that the development has been signed up to and included within the Environment Agency's Floodline Warnings Direct (FWD) service, and shall provide details of how the development shall manage flood risk and evacuation requirements. The development shall thereafter be operated in full accordance with the details of the Flood Warning and Evacuation Plan as approved. Reason: In the interests of public protection against flood risk, in accordance with adopted policies CS13 of the Great Yarmouth Core Strategy (2015) and policy E1 of the Great Yarmouth Local Plan Part 2 (2021).
.REASON FOR APPROVAL OF THE APPLICATION Subject to appropriate conditions, the proposal has been considered to address policies CS8, CS9, CS11, CS13 and CS15 of the adopted Core Strategy (2015) and policies GSP5, GY8, E1, E3, E4 and E6 of the adopted Local Plan Part 2 (2021).
.STATEMENT OF POSITIVE ENGAGEMENT In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
.NOTES - Please read the following notes carefully:- Given the proximity of the site to a protected environmental zone any use of pesticides on the surface should be carefully considered and preferably avoided.
.INFORMATIVE NOTE The applicant and developer are advised to consider the advice from the Internal Drainage Board provided within the application case file (see website) and for convenience replicated below: Byelaw 3 - Surface Water: If the applicant intends to dispose of surface water via infiltration, ground investigation is carried out to determine infiltration potential, followed by testing in line with BRE Digest 365 if onsite material is considered favourable for infiltration. If infiltration is not feasible at this site, following the drainage hierarchy we would expect the applicant to propose to discharge surface water to a watercourse. In this case, consent would be required under Byelaw 3. Please note that we recommend that any discharge is in line with the Non-Statutory technical standards for sustainable drainage systems (SuDS), therefore the Board is unlikely to grant consent for discharges in excess of greenfield rate. Byelaw 3 - Foul Water: The applicant shall need to confirm how they intend to dispose of the foul waste. If the applicant proposes to discharge treated foul water to a watercourse, Land Drainage Consent would be required under Byelaw 3. Section 23, Land Drainage Act 1991: The IDB note the presence of a watercourse which is not maintained by the Board (a riparian watercourse) within the site boundary, bordering the northern, southern and western boundaries of the site. Whilst not currently proposed, should the applicant's proposals change to include works to alter the riparian watercourse, or if works are proposed to alter the watercourse at any time in the future, consent would be required under the Land Drainage Act 1991 (and byelaw 4).
