1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the following revised plans and documents received by the Local Planning Authority on the 23rd August 2022: - Site Location Plan: AP0001 Rev.C - Block Plan: AP0002 Rev.C - Proposed Location Plan: AP0005 Rev.B - Proposed Site Plan: AP0090 Rev.D - Proposed Ground Floor Plan: AP0100 Rev C - Proposed Ground Floor Plan Link Corridor: AP0100_1 Rev A - Proposed Plant Floor Plan: AP0101 Rev.C - Proposed Plant Floor Plan Link Corridor: AP0101_1 Rev A - Proposed Roof Plan: AP0102 Rev.C - Proposed Roof Plan Link Corridor: AP0102_01 Rev.A - Proposed Master Plan: AP0110 Rev.C - Proposed Elevations - East and South: AP0200 Rev.D - Proposed Elevations - West and North: AP0201 Rev.D - Proposed Site Sections: AP0300 Rev.B - Indicative Landscape Plan: AP0900 Rev.A - Material Statement: 00151_MS The reason for the condition is:- For the avoidance of doubt.
3.Notwithstanding the submitted details, prior to first use of the Decant Ward hereby permitted, full details of a soft and hard landscaping scheme shall be first been submitted to and approved in writing by the Local Planning Authority. The precise details of the landscaping proposals shall include: - full specifications of all new planting along with details for their protection during establishment, and - details of all hard landscaping materials, including fences and any boundary treatments. The development shall be carried out in accordance with the agreed details before the first use of the development [or within such other period as is agreed in writing with the Local Planning Authority]. For the avoidance of doubt, all species used in the planting proposal shall be locally native species of local provenance unless otherwise agreed in writing with the Local Planning Authority. The reason for the condition is :- Because the precise details have not been submitted and in the interests of the satisfactory visual amenity.
4.The approved planting scheme secured by condition 3 of this permission shall be carried out in its entirety within the first planting and growing season following the first use of the Decant Ward hereby permitted. For the duration of a period of 10 years from the first use of the Decant Ward, any trees, shrubs or hedges planted in accordance with the landscaping scheme which die, are removed or become seriously damaged or diseased shall be replaced in the next immediate planting season with others of similar size and species, unless the Local Planning Authority gives its first written consent to any variation thereof. The reason for the condition is :- To ensure an high quality form of development and in the interests of ensuring appropriate visual amenity for the local area, to enhance biodiversity and to secure appropriate residential amenity.
5.Prior to the first use of the Decant Ward, a biodiversity enhancement plan shall be submitted to and approved in writing by the Local Planning Authority, detailing the enhancement measures for biodiversity on site. The measures shall be carried out strictly in accordance with the approved scheme. The reason for the condition is :- To ensure that the application complies with core policy CS11 of the Core Strategy.
6.Prior to the commencement of the development hereby permitted, tree protection works shall be carried out in accordance with the details contained on page 6 of the Arboricultural Impact Assessment (OAS 22-180-AR01 Rev B) submitted with the application. The tree protection works shall be maintained during the entire course of construction. The reason for the condition is :- To ensure that no damage occurs to the trees during the course of construction.
7.In the event that contamination that was not previously identified is found at any time when carrying out the approved development, it must be reported in writing immediately to the Local Planning Authority. All development shall cease and shall not recommence until: 1) a report has been submitted and agreed in writing by the Local Planning Authority which includes results of an investigation and risk assessment together with proposed remediation scheme to deal with the risk identified and 2) the agreed remediation scheme has been carried out and a validation report demonstrating its effectiveness has been approved in writing by the Local Planning Authority. The reason for the condition is :- To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors.
8.Construction work shall not take place outside the following hours:- 08:00 to 18:00 Mondays 08:00 to 18:00 Tuesdays 08:00 to 18:00 Wednesdays 08:00 to 18:00 Thursdays 08:00 to 18:00 Fridays 08:30 to 13:30 Saturdays and no work shall take place on Sundays or Bank Holidays. (These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property) The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings.
9.Prior to the first use of the generator, the acoustic enclosure surrounding the generator unit, as illustrated on plan AP0300 Rev.B shall be installed in its entirety. The acoustic enclosure shall be retained thereafter in perpetuity in accordance with the approved details unless the Local Planning Authority gives its first written consent to any variation thereof. The reason for the condition is :- In the interests of visual amenity and providing adequate levels of sound mitigation.
10.Within 12 months of the first use of the Decant Ward hereby permitted the proposed on-site car and cycle parking/servicing/loading/unloading/turning/waiting areas shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan and retained thereafter available for that specific use. The reason for the condition is: - To ensure the permanent availability of the parking/manoeuvring areas, in the interests of satisfactory development and highway safety.
11.Within 12 months of the first use of the Decant Ward the Interim Travel Plan shall be implemented. Within 24 months of the first use of the Decant Ward, an approved Full Travel Plan based on the Interim Travel Plan shall be submitted to and approved in writing by the Local Planning Authority. The approved Full Travel Plan shall be implemented in accordance with the timetable and targets contained therein and shall continue to be implemented as long as any part of the development is occupied subject to approved modifications agreed by the Local Planning Authority as part of the annual review. The reason for the condition is :- To ensure that the development offers a wide range of travel choices to reduce the impact of travel and transport on the environment.
12.The development shall be built in accordance with the submitted Flood Risk Assessment (Flood Risk Assessment | Proposed Modular Building at the James Paget University Hospital NHS Foundation Trust, Lowestoft Road, Gorleston, Norfolk | Evans River and Coastal LTD | Ref: 2916/RE/04-22/01 | Rev: A | Dated: August 2022) and Drainage Strategy (Drainage Strategy | James Paget University Hospital New Modular Ward Block | WSP | Ref: 70094109 - JPHU New Ward Block | Rev: 4 | Dated: August 2022). The schematic drainage layout adopted must be that demonstrated in the final submitted drainage strategy drawing (Proposed Surface and Foul Water Drainage | WSP | Drawing No: 4109-WSP-00-XX-DR-CV-100501 | Rev: P01 | Dated: August 2022). The approved scheme will be implemented prior to the first use of the development. The reason for the condition is :- To prevent flooding in accordance with National Planning Policy Framework paragraph 167, 169 and 174 by ensuring the satisfactory management of local flood risk, surface water flow paths, storage and disposal of surface water from the site in a range of rainfall events and ensuring the SuDS proposed operates as designed for the lifetime of the development.
13.REASON FOR APPROVAL OF THE APPLICATION :- The proposal meets the aims of Core Policy CS15.
14.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
15.NOTES - Please read the following notes carefully:- The site will potentially generate a significant amount of dust during the conversion process; therefore, the following measures should be employed: - - An adequate supply of water shall be available for suppressing dust; - Mechanical cutting equipment with integral dust suppression should be used; - There shall be no burning of any materials on site.
16.NOTES - Please read the following notes carefully:- Construction noise notification: NOTE: The applicant is strongly recommended to advise neighbouring businesses and residential occupiers of the proposals, including any periods of potentially significant disturbance e.g. demolition or piling, together with contact details in the event of problems. Contamination Disclaimer: NOTE: The responsibility for the safe development and secure occupancy of the site rests with the developer. The local planning authority has determined the application on the basis of the information available to it, but this does not mean that the land is free from contamination, or that the land could not be declared Contaminated Land in future.

It appears that development proposals will affect existing public sewers. It is recommended that the applicant contacts Anglian Water Development Services Team for further advice on this matter. Building over existing public sewers will not be permitted (without agreement) from Anglian Water. (4) INFORMATIVE - Building near to a public sewer - No building will be permitted within the statutory easement width of 3 metres from the pipeline without agreement from Anglian Water. If the developer wishes to have the sewers included in a sewer adoption agreement with Anglian Water (under Sections 104 of the Water Industry Act 1991), they should contact our Development Services Team on 0345 606 6087 at the earliest opportunity. Sewers intended for adoption should be designed and constructed in accordance with Sewers for Adoption guide for developers, as supplemented by Anglian Water's requirements.
