No.Condition Text
.The balcony would lead to an unacceptable level of overlooking into the neighbour's garden, resulting in an overbearing and an oppressive living environment for the neighbours occupying the annex at 8a Pound Lane which would not be sufficiently mitigated by the inclusion of the obscure panel on the balcony. As such the application fails to comply with policy A1 and CS09 F which seek to protect neighbouring amenity.
.Removal of the lean-to pitched roof and inclusion of a balcony would result in a stark contrast between the appearance of the original dwelling and the extensions due the extent of flat roof. This would be contrary to H9 A which states that proposals must "a. maintain or enhance the character and appearance of the building, street scene, its immediate surroundings and the wider townscape or landscape;" and CS09 A which requires proposals to respect the surrounding built environment.
.The change to a black tile would disrupt the shared identity of the line of semi detached properties on the eastern side of Pound Lane, as well as providing an imbalance to the semi when viewed front on from the highway. This is contrary to CS09 A which requires developments to "respond to, and draw inspiration from the surrounding area's distinctive natural, built and historic characteristics, such as scale, form, massing and materials".
.STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
