1.The angled layout on the plot, along with the very close proximity to the donor dwelling creates an uncomfortable and unfavourable relationship between the proposed holiday units and the donor dwelling. This relationship would be contrary to the surrounding character which is defined by the spacing between the properties which front directly onto the road, and have gardens to the rear and is harmful to the character of the Conservation Area. This is contrary to policies E5 and CS10 which seeks to ensure that proposal maintain or enhance the character of Conservation Areas.
2.Due to the size of the buildings and positioning on the plot, there is insufficient space for rear gardens. This is contrary to A2 C which requires proposals to "face streets with private areas to the rear of the buildings"; because of this, the proposal would appear cramped on the site, resulting in the over-development of the plot.
3.The proposal would be located close to the boundary to no.16 Marine Parade, and the holiday flats would be significantly taller than the existing ground floor projection. This, combined with the proximity to the boundary and orientation would result in an increased sense of enclosure and overshadowing to the rear garden of no.16 Marine Parade having an overbearing impact. This is contrary to the aims of CS09 F and A1.
4.There are west facing windows at first and second floor level within the donor dwelling which would have restricted outlook and light by virtue of the limited distance between this and the new holiday units. This would erode amenity to the level that it would be significantly detrimental to occupiers of the first floor flat. This is contrary to the aims of CS09 F and A1.
5.A number of trees would require removal to facilitate the development, in particular there is a mature tree (maple) which provides a contribution to the visual amenity of the street scene and wider Conservation Area. No arboricultural impact assessment has been submitted as part of this application to justify their removal. This is contrary to policy E4.
6.STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
