| 1. | The development must be begun not later than three years beginning with the date of this permission.
The reason for the condition is :-
The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
| 2. | The development shall be carried out in accordance with the following plans received by the Local Planning Authority on the 4th April 2022:
Location Plan: PL01
Proposed Block Plan: PL03
Proposed Floor Plans: PL04
Proposed Sections: PL05
Proposed Elevation: PL06
The materials to be used in the development hereby permitted, including the brick bond and mortar, shall be those specified on approved drawing PL06.
The reason for the condition is :-
For the avoidance of doubt and to ensure the development is sympathetic to its heritage setting and for the preservation of heritage assets. |
| 3. | No works shall commence until a ground investigation and an interpretive report provided by geotechnical specialists in order to inform the engineering design of the Pool Hall foundations has first been submitted to and agreed in writing by the Local Planning Authority. The investigation scope should include for exposing the base of the existing garden wall so that depth / width can be established where excavations are proposed in the proximity of the walled garden enclosure.
The reason for the condition is :-
To ensure that the wall is not harmed by the proposed works - in line with paragraph 5.9 of the engineers report and the requirement to protect heritage assets. |
| 4. | No works shall commence until details of proposed wall repair, including the extent of any replacement brickwork, have first been submitted to and agreed in writing by the Local Planning Authority. The works shall take place in accordance with the approved details.
For the avoidance of doubt, works to repair the wall shall take place outside of bird nesting season.
The reason for the condition is :-
To ensure that works to repair the wall are undertook in a sensitive manner and to protect nesting birds. |
| 5. | No works shall commence until a strategy detailing the measures to protect the listed garden wall during the works has first been submitted to and approved in writing by the Local Planning Authority. The works shall take place in accordance with the approved details.
The reason for the condition is :-
In order to ensure that the wall is adequately protected during the works. |
| 6. | The approved planting scheme as shown on drawing Proposed Site Plan PL 03 shall be carried out in its entirety within the first planting and growing season following the first use of the outbuilding hereby permitted. For the duration of a period of 10 years from the first use of the outbuilding, any trees, shrubs or hedges planted in accordance with the landscaping scheme which die, are removed or become seriously damaged or diseased shall be replaced in the next immediate planting season with others of similar size and species, unless the Local Planning Authority gives its first written consent to any variation thereof.
The reason for the condition is :-
To ensure an high quality form of development and in the interests of ensuring appropriate visual amenity for the local area, to enhance biodiversity and to secure appropriate residential amenity. |
| 7. | The pool house hereby permitted shall only be used for purposes incidental to residential occupancy of the dwelling known as Burnley Hall Estate, and shall not be used for any business or commercial activity whatsoever, nor shall it be let out for hire or used for overnight accommodation, at any time.
The reason for the condition is :-
For clarity where commercial use could give rise to amenity or highways impacts, and to ensure there is no additional excess loading of nutrients into the watercourse system and ecological receptors without first having explored the options for mitigation thereof. |
| 8. | In the event that contamination that was not previously identified is found at any time when carrying out the approved development, it must be reported in writing immediately to the Local Planning Authority. All development shall cease and shall not recommence until:
1) a report has been submitted and agreed in writing by the Local Planning Authority which includes results of an investigation and risk assessment together with proposed remediation scheme to deal with the risk identified and
2) the agreed remediation scheme has been carried out and a validation report demonstrating its effectiveness has been approved in writing by the Local Planning Authority.
The reason for the condition is :-
To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors. |
| 9. | Construction work shall not take place outside the following hours:-
08:00 to 18:00 Mondays
08:00 to 18:00 Tuesdays
08:00 to 18:00 Wednesdays
08:00 to 18:00 Thursdays
08:00 to 18:00 Fridays
08:30 to 13:30 Saturdays
and no work shall take place on Sundays or Bank Holidays.
(These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property)
The reason for the condition is :-
In the interests of the residential amenities of the occupiers of nearby dwellings. |
| 10. | No use of the outbuilding hereby approved shall occur until no fewer than 2no. bird boxes and 2no. bat boxes have first been installed in their entirety on the external walls of the outbuilding. The bird and bat boxes shall remain in perpetuity.
The reason for the condition is :-
To secure biodiversity enhancements in line with the NPPF. |
| 11. | In the event that the swimming pool should ever need to be emptied and the water discharged to non-mains sewer systems, the following precautions shall be taken unless an alternative method statement has first been submitted to and approved in writing by the Local Planning Authority, in which case the procedures should be followed as approved:
In the event pool needs to be emptied this can done either by having a holding tank installed or by draining the pool directly to an appropriate location via the use of submergible pumps, he chlorine content on the water shall first be neutralised, by using a Sodium Thiosulfate (Na2S2O3) solution disseminated into the pool, which acts as a chlorine neutralizer making the water safe to discharge. Thereafter the water shall be tested to ensure the chlorine content has reached acceptable levels before the pool is drained.
The reason for the condition is :-
To ensure that risks of contamination to watercourses is removed, in particular with regard to the need to avoid the risk of increased nutrient loading or chemical impact upon SSSIs and protected watercourse systems, in the interests of protecting controlled waters and ecological systems. |

The applicant is strongly recommended to advise neighbouring businesses and residential occupiers of the proposals, including any periods of potentially significant disturbance e.g., demolition or piling, together with contact details in the event of problems.
Disclaimer re contamination
NOTE: The responsibility for the safe development and secure occupancy of the site rests with the developer. The local planning authority has determined the application based on the information available to it, but this does not mean that the land is free from contamination, or that the land could not be declared Contaminated Land in future.
Local Air Quality:
The site will potentially generate a significant amount of dust during the construction process; therefore, the following measures should be employed:
· An adequate supply of water shall be available for suppressing dust.
· Mechanical cutting equipment with integral dust suppression should be used.
· There shall be no burning of any materials on site, or burial of asbestos, which should instead be removed by an EA licenced waste carrier, and the waste transfer notes retained as evidence. |
