1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is:- Required to be imposed pursuant to Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development including materials shall be carried out in accordance with the application form and following revised plans: - Site location and proposed block plan - 1520/DK1 - Sheet 1; and, - Existing and proposed elevations - 1520/DK1 - Sheet 2, as received by the Local Planning Authority on 7th July 2022. The reason for the condition is:- For the avoidance of doubt.
3.There shall be no residential use or occupation of any of the flats within the development permitted by planning permission 06/20/0391/CU until such time as the parking and access has first been provided in either of the following ways: (a) the full extent of the frontage boundary wall shall first be constructed in strict accordance with the details shown in plan 1520/DK1 - Sheet 1 and Sheet 2, approved as part of this permission; or, (b) the parking shall be laid out in accordance with the details required by condition 3 of permission 06/20/0391/CU. The reason for the condition is :- In the interests of visual amenity, to ensure there are appropriate heritage references within the development, and to ensure appropriate highway safety is maintained.
4.Prior to the first use of the development hereby permitted the vehicular access into the site shall be provided in accordance with the highways specification (TRAD 1) and thereafter shall be retained at the position shown on the approved plan. Arrangement shall be made for surface water drainage to be intercepted and disposed of separately so that it does not discharge from or onto the highway. The reason for the condition is: - To ensure construction of a satisfactory access and to avoid carriage of extraneous material or surface water from or onto the highway in the interests of highway safety.
5.Notwithstanding the provision of the Town and Country Planning (General Permitted Development) Order (2015) (or any Order revoking, amending or re-enacting that Order), no gates/bollard/chain/other means of obstruction shall be erected across the approved access unless details have first been submitted to and approved in writing by the Local Planning Authority. The reason for the condition is: - In the interests of highway safety.
6.REASON FOR APPROVAL OF THE APPLICATION :- The application is consistent with the aims set out in Core Policies CS09 and CS16 of the adopted Core Strategy
7.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
8.NOTE to Applicant and Developer - This development involves works within the public highway that can only be carried out by Norfolk County Council as Highway Authority unless otherwise agreed in writing. It is an OFFENCE to carry out any works within the Public Highway, which includes a Public Right of Way, without the permission of the Highway Authority. Please note that it is the Applicant's responsibility to ensure that, in addition to planning permission, any necessary consents or approvals under the Highways Act 1980 and the New Roads and Street Works Act 1991 are also obtained from the County Council. Advice on this matter can be obtained from the County Council's Highway Development Management Group, tel: 0344 800 8020 or email: developer.services@norfolk.gov.uk If required, street furniture will need to be repositioned at the Applicant's own expense. Public Utility apparatus may be affected by this proposal. Contact the appropriate utility service to reach agreement on any necessary alterations, which have to be carried out at the expense of the developer.
9.NOTE to Applicant and Developer - Condition 3 of Planning Permission 06/20/0391/CU (Change of use to create 6 self-contained flats and conversion of outbuilding to create self-contained dwelling) states: "Prior to the first occupation of the development hereby permitted the proposed access, on-site car parking and turning area shall be laid out, demarcated, levelled, surfaced, and drained in accordance with the approved plan and retained thereafter available for that specific use." The applicant and developer may wish to consider making an application to vary the terms of the existing condition 3 to regularise the non-compliance with that condition if this permission is implemented. Such a variation of condition application would refer to condition 3, requesting that the condition be amended to instead require the proposal as approved under this application 06/22/0287/F to be implemented within accordance with the approved plan 1520/DK1 (sheets 1 and 2).
