1.This permission expires on 1st December 2024 and unless on or before this date application has been made for an extension to the period of permission and such application is approved by the Local Planning Authority the structures hereby approved, the use of the site for car wash/valeting shall cease and the display of cars for sales purposes shall be removed from the site. The reason for the condition is:- In order to retain control over the development in the interests of the visual amenities and wider Great Yarmouth Waterfront Area.
2.The development shall be carried out in accordance with the following revised plans received by the Local Planning Authority on 04/02/2020 as part of application - 06/19/0572/CU Drawing Number MJSM29012020 DRW A. The reason for the condition is:- For the avoidance of doubt.
3.Notwithstanding the submitted details or the provisions of the Town and Country Planning Use Classes Order 1987 (or any Order revoking or re-enacting that Order) the structure referred to as 'mobile office and waiting room' on the approved plan shall only be used for an office and waiting room for the existing hand car wash only and shall not be used for residential or holiday purposes nor shall the structure be used for sleeping accommodation at any time. The reason for the condition is:- The use is for the staff of the car wash only and is not suitable for alternative uses. In addition the Local Planning Authority will retain control of the site in accordance with policy CS17 of the adopted Core Strategy.
4.No structures (shipping containers or mobile offices) shall be sited within 1m of the flood defence wall, to allow periodic access to/improvement/protection/maintenance of existing flood defences by Environment Agency engineers is maintained. The structures shall be securely tethered to prevent their movement in the event of a flood situation. Reason for condition: - To ensure the structural integrity of existing and proposed flood defences thereby reducing the risk of flooding.
5.Surface water from areas of hardstanding, shall be passed through an oil interceptor or series of oil interceptors, prior to being discharged to any watercourse, soakaway or surface water system. The separator shall be designed with a capacity adequate for the areas being drainage, and shall be installed and be available for use, prior to the development being brought in to use, and shall thereafter be retained and maintained for the lifetime of the development. Clean roof water and vehicle wash-downs and detergents shall not be passed through the interceptor and shall be drained to the foul sewer or sealed system. Reason for condition: - To reduce the risk to the water environment, from trade effluent/waste.
6.A copy of the Flood Response Plan received by the Local Planning Authority on the 19 November 2018 (in relation to the previous approval ref 06/18/0571/F Approved 30/11/18) shall be clearly displayed on site and shall be reviewed and updated in accordance with the schedule detailed within the submitted Flood Response Plan. The reason for the condition is :- To provide advice to the occupiers of the site should the site flood.
7.The car-sales hereby approved shall be limited to a maximum number of 4 vehicles displayed for sale, which shall be located only within the positions , as shown on the approved drawing number Drawing Number MJSM29012020 DRW A, and from no other part of the site. The reason for the condition is :- In the interest of visual amenity and to ensure the availability of the parking/manoeuvring areas, in the interests of satisfactory development and highway safety.
8.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner, in accordance with paragraphs 186 and 187 of the NPPF.
9.Environment Agency Advice Effluent discharged from premises carrying out a trade or industry, and effluent generated by a commercial enterprise where the effluent is different from domestic waste, is classed as trade effluent. If you are not able to discharge the effluent, it is classed as trade waste, and you will need to comply with duty of care responsibilities. Discharge to Non-mains - If you wish to discharge treated effluent after appropriate treatment to the ground or surface water, please contact the Env Agency on 03708 506506, as a permit under the Environmental Permit Regulations will be required. Discharge to Mains - A permit or service agreement may be needed with the appropriate Water or Drainage undertaker for discharge of effluent to any public sewer od[r system which connects to a public sewer.
