1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the following plans received by the Local Planning Authority on the 23rd March 2022: - Site Location: 20011-LSI-JPH-XX-DR-A-1170 Rev P05 - Proposed General Arrangement - First Floor: 20011-LSI-JPH-01-DR-A-1301 Rev P05 - Proposed General Arrangement - Roof: 20011-LSI-JPH-RF-DR-A-1315 Rev P05 and the development shall be carried out in accordance with the following revised plans received by the Local Planning Authority on the 17th May 2022: - Proposed Site Plan: 20011-LSI-JPH-XX-DR-A-1172 Rev P09 - Site Section: 20011-LSI-JPH-XX-DR-A-1173 Rev P05 - Block Plan: 20011-LSI-JPH-XX-DR-A-1175 Rev P06 - Indicative Landscape Plan: 20011-LSI-JPH-XX-DR-A-1180 Rev P06 - Proposed General Arrangement - Ground Floor: 20011-LSI-JPH-GF-DR-A-1300 Rev P06 - Proposed General Arrangement Elevations 20011-LSI-JPH-ZZ-DR-A-1350 Rev P05 North, East, South and West Elevations: - Proposed General Arrangement Elevations Sheet 02: 20011-LSI-JPH-ZZ-DR-A-1351 Rev P03 - External Works General Arrangement (surface water C-001 Rev P04 drainage plan): The reason for the condition is:- For the avoidance of doubt.
3.In the event that contamination that was not previously identified is found at any time when carrying out the approved development, it must be reported in writing immediately to the Local Planning Authority. All development shall cease and shall not recommence until: 1) a report has been submitted and agreed in writing by the Local Planning Authority which includes results of an investigation and risk assessment together with proposed remediation scheme to deal with the risk identified and 2) the agreed remediation scheme has been carried out and a validation report demonstrating its effectiveness has been approved in writing by the Local Planning Authority. The reason for the condition is :- To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors.
4.No works above damp proof level shall take place until the exact types and colours of the materials have been submitted to and approved in writing by the Local Planning Authority. The development shall be carried out using the agreed materials. The reason for the condition is :- In the interests of the visual amenities of the area as precise details of the materials have not been submitted.
5.Notwithstanding the submitted details, prior to roof works, full details of a soft and hard landscaping scheme, including boundary treatments, shall be first been submitted to and approved in writing by the Local Planning Authority. The precise details of the landscaping proposals shall include: - full specifications of all new planting along with details for their protection during establishment, and - details of all hard landscaping materials, including fences and any boundary treatments. The development shall be carried out in accordance with the agreed details before the first use of the development. The reason for the condition is :- Because the precise details have not been submitted and in the interests of the satisfactory visual amenity.
6.The approved planting scheme secured by condition 5 of this permission shall be carried out in its entirety within the first planting and growing season following the first use of the DAC hereby permitted. For the duration of a period of 10 years from the first use of the DAC, any trees, shrubs or hedges planted in accordance with the landscaping scheme which die, are removed or become seriously damaged or diseased shall be replaced in the next immediate planting season with others of similar size and species, unless the Local Planning Authority gives its first written consent to any variation thereof. The reason for the condition is :- To ensure an high quality form of development and in the interests of ensuring appropriate visual amenity for the local area, to enhance biodiversity and to secure appropriate residential amenity.
7.Prior to roof works taking place, a biodiversity enhancement plan shall be submitted to and approved in writing by the Local Planning Authority, detailing the enhancement measures for biodiversity on site. The measures shall be carried out strictly in accordance with the approved scheme. The reason for the condition is :- To ensure that the application complies with core policy CS11 of the Core Strategy.
8.Prior to roof works taking place, a Lighting Strategy shall be submitted to and approved in writing by the Local Planning Authority, detailing the proposed lighting measures for external areas to provide adequate levels of surveillance. The measures shall be carried out strictly in accordance with the approved scheme. The reason for the condition is :- To ensure the provision adequate external lighting.
9.Prior to the first use of the development hereby permitted the proposed on-site car parking/servicing/loading/unloading/turning/waiting area shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan and retained thereafter available for that specific use. The reason for the condition is: - To ensure the permanent availability of the parking/manoeuvring areas, in the interests of satisfactory development and highway safety.
10.Prior to the first use of the DAC development hereby permitted, the acoustic enclosure surrounding the generator unit, as illustrated on plan 20011-LSI-JPH-XX-DR-A-1180 Rev P06, shall be installed in its entirety. The acoustic enclosure shall be retained thereafter in perpetuity. The reason for the condition is :- In the interests of visual amenity and providing adequate levels of sound mitigation.
11.Within 12 months of the first use of the DAC the the Interim Travel Plan shall be implemented. Within 24 months of the first use of the DAC, an approved Full Travel Plan based on the Interim Travel Plan shall be submitted to and approved in writing by the Local Planning Authority. The approved Full Travel Plan shall be implemented in accordance with the timetable and targets contained therein and shall continue to be implemented as long as any part of the development is occupied subject to approved modifications agreed by the Local Planning Authority as part of the annual review. The reason for the condition is :- To ensure that the development offers a wide range of travel choices to reduce the impact of travel and transport on the environment.
12.Construction work shall not take place outside the following hours:- 07:30 to 18:30 Mondays 07:30 to 18:30 Tuesdays 07:30 to 18:30 Wednesdays 07:30 to 18:30 Thursdays 07:30 to 18:30 Fridays 08:30 to 13:30 Saturdays and no work shall take place on Sundays or Bank Holidays. (These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property) The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings.
13.REASON FOR APPROVAL OF THE APPLICATION :- The proposal meets the aims of Core Policy CS15.
14.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
15.NOTES - Please read the following notes carefully:- The site will potentially generate a significant amount of dust during the conversion process; therefore, the following measures should be employed: - - An adequate supply of water shall be available for suppressing dust; - Mechanical cutting equipment with integral dust suppression should be used; - There shall be no burning of any materials on site.
16.NOTES - Please read the following notes carefully:- Advisory Note The applicant is strongly recommended to advise neighbouring businesses and residential occupiers of the proposals, including any periods of potentially significant disturbance e.g., demolition or piling, together with contact details in the event of problems. Disclaimer re contamination NOTE: The responsibility for the safe development and secure occupancy of the site rests with the developer. The local planning authority has determined the application based on the information available to it, but this does not mean that the land is free from contamination, or that the land could not be declared Contaminated Land in future.
17.NOTES - Please read the following notes carefully:- INFORMATIVE - Notification of intention to connect to the public sewer under S106 of the Water Industry Act Approval and consent will be required by Anglian Water, under the Water Industry Act 1991. Contact Development Services Team 0345 606 6087. INFORMATIVE - Protection of existing assets - A public sewer is shown on record plans within the land identified for the proposed development. It appears that development proposals will affect existing public sewers. It is recommended that the applicant contacts Anglian Water Development Services Team for further advice on this matter. Building over existing public sewers will not be permitted (without agreement) from Anglian Water. INFORMATIVE - Building near to a public sewer - No building will be permitted within the statutory easement width of 3 metres from the pipeline without agreement from Anglian Water. Please contact Development Services Team on 0345 606 6087. INFORMATIVE: The developer should note that the site drainage details submitted have not been approved for the purposes of adoption. If the developer wishes to have the sewers included in a sewer adoption agreement with Anglian Water (under Sections 104 of the Water Industry Act 1991), they should contact our Development Services Team on 0345 606 6087 at the earliest opportunity. Sewers intended for adoption should be designed and constructed in accordance with Sewers for Adoption guide for developers, as supplemented by Anglian Water's requirements.
