1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the following revised plans: a) 919 1/2A, entitled Erection of Two Detached Bungalows (submitted as the Site and Floor Plans), dated 13/06/22 (received by the Local Planning Authority on the 20th June 2022); b) 919 2/2A, entitled Erection of Two Bungalows (submitted as the Block Plan and Proposed Elevations), dated 13/06/22 (received by the Local Planning Authority on the 20th June 2022); c) 919 4/5A, entitled Erection of Two Detached Bungalows (submitted as the Drainage Plan), dated 13/06/22 (received by the Local Planning Authority on the 7th July 2022). The reason for the condition is:- For the avoidance of doubt.
3.The materials to be used in the external walls and roof of the development hereby permitted shall accord with the details stated in the application form. The reason for the condition is :- In the interests of the visual amenities of the area in accordance with Policy A2 of the adopted Great Yarmouth Local Plan Part 2 (2021).
4.In the event that contamination that was not previously identified is found at any time when carrying out the approved development, it must be reported in writing immediately to the Local Planning Authority. All development shall cease and shall not recommence until: a) a report has been submitted and agreed in writing by the Local Planning Authority which includes results of an investigation and risk assessment together with proposed remediation scheme to deal with the risk identified; and b) the agreed remediation scheme has been carried out and a validation report demonstrating its effectiveness has been approved in writing by the Local Planning Authority. The reason for the condition is :- To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors in accordance with Policy E6 of the adopted Great Yarmouth Local Plan Part 2 (2021).
5.Vehicular access to and egress from the adjoining highway shall be limited to the accesses shown on Drawing No. 912-1/2A only. Any other access or egress shall be permanently closed, and the footway/highway verge shall be reinstated in accordance with a detailed scheme to be agreed with the Local Planning Authority concurrently with the bringing into use of the new access. The reason for the condition is: - In the interests of highway safety in accordance with Policy CS16 of the adopted Great Yarmouth Local Plan Core Strategy (2015).
6.No works above slab level shall take place until a statement demonstrating how the dwelling will be designed and built to achieve a water consumption rate of no more than 110 litres/person/day has been first submitted to and approved in writing by the Local Planning Authority. All required water conservation measures within the approved details shall thereafter be installed and maintained to achieve this agreed rate to ensure the required water consumption is not exceeded for the lifetime of the development. The reason for the condition is: - In the interests of promoting and securing water efficiency improvements to a higher standard than Building Regulations minimum standards require, to accord with adopted Local Plan Part 2 policy E7 of the adopted Great Yarmouth Local Plan Part 2 (2021). Note to applicant - The imposition of this planning condition requires the development to achieve a higher standard of construction than the current minimum national requirement through Building Regulations. This requires you / the Developer to ensure that the standard is adhered to when seeking Building Regulations Completion Notice approval (whether using local authority inspectors or third party approved inspectors).
7.No works above slab level shall take place until details in written and drawn form of the means by which electric vehicle charging shall be provided within the scheme shall be submitted to and approved in writing by the Local Planning Authority. The works shall accord to the approved scheme and shall be retained thereafter. The reason for the condition is: - To allow provision for the demand for electric vehicle charging within the lifetime of the development in line with the requirements of the adopted Great Yarmouth Local Plan Part 2 (2021) Policy I1.
8.No works above slab level shall take place until a scheme that demonstrates how the dwellings will be built to meet requirement M4(2) of Part M of the Building Regulations for accessible and adaptable dwellings, where practicable, has first been submitted to and approved in writing by the Local Planning Authority. The development shall thereafter be constructed in strict accordance with the details so approved. The reason for the condition is :- To ensure that the dwellings are designed to be adaptable and efficient for lifetime occupation and to provide appropriate long term residential amenity in line with the requirements of the adopted Great Yarmouth Local Plan Part 2 (2021) Policy A2.
9.No works above slab level shall take place until full details of a soft and hard landscaping scheme has first been submitted to and approved in writing by the Local Planning Authority. The precise details of the landscaping proposals shall include: - full specifications of all new planting along with details for their protection during establishment, and - details of all hard landscaping materials. The development shall be carried out in accordance with the approved details before the first occupation of the development. For the avoidance of doubt, all species used in the planting proposal shall be locally native species of local provenance. The reason for the condition is :- Because the precise details have not been submitted and in the interests of the satisfactory visual amenity in accordance with Policy A1 of the adopted Great Yarmouth Local Plan Part 2 (2021).
10.The approved planting scheme secured by Condition 9 of this permission shall be carried out in its entirety within the first planting and growing season following the first occupation of the dwelling to which the planting relates. For the duration of a period of 10 years from the first occupation of the dwellings, any trees, shrubs or hedges planted in accordance with the landscaping scheme which die, are removed or become seriously damaged or diseased shall be replaced in the next immediate planting season with others of similar size and species. The reason for the condition is :- To ensure an high quality form of development and in the interests of ensuring appropriate visual amenity for the local area, to enhance biodiversity and to secure appropriate residential amenity in accordance with Policies CS11 of the adopted Great Yarmouth Local Plan Core Strategy (2015) and Policy A2 of the adopted Great Yarmouth Local Plan Part 2 (2021).
11.Prior to the first occupation of the development hereby permitted, the vehicular crossings shall be constructed in accordance the highways specification (TRAD 1) and thereafter retained at the positions shown on the approved plan. Arrangement shall be made for surface water drainage to be intercepted and disposed of separately so that it does not discharge from or onto the highway. The reason for the condition is: - To ensure construction of a satisfactory access and to avoid carriage of extraneous material or surface water from or onto the highway in the interests of highway safety in accordance with Policy CS16 of the adopted Great Yarmouth Local Plan Core Strategy (2015).
12.Prior to the first occupation of the development hereby permitted the proposed access, on-site car parking and turning areas shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan and retained thereafter available for that specific use. The reason for the condition is: - To ensure the permanent availability of the parking/manoeuvring areas, in the interests of satisfactory development and highway safety in accordance with Policy I1 of the adopted Great Yarmouth Local Plan Part 2 (2021).
13.Prior to the first occupation of the dwellings, no fewer than one swift terrace box per dwelling shall be installed on the western gable wall of the garages. The bird boxes shall remain in perpetuity. The reason for the condition is :- To secure biodiversity enhancements in line with the NPPF.
14.There shall be no occupation or use of the development hereby permitted until the development has first been connected to the mains sewer system and made operational and available for use. The development shall remain connected to the public mains sewer network thereafter. The reason for the condition is :- To ensure the development will not lead to nutrient pollution concerns within the the Broads SAC catchment, by ensuring effluent is treated outside of the known Nutrient Neutrality catchment area, by connection to the mains sewerage system with subsequent effluent treatment at a water recycling centre which discharges waste outside of the Nutrient Neutrality catchment.
15.Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any amendment revoking or re-enacting that Order) the dwellings hereby permitted shall not be further extended in any way without first obtaining the express written permission of the Local Planning Authority. The reason for the condition is:- To enable the Local Planning Authority to retain control over any further extensions to the dwelling in the interests of residential amenity.
16.REASON FOR APPROVAL OF THE APPLICATION :- The proposal provides dwellings within a sustainable location within a primary village complying with the aims of Core Policies CS01 and CS02.
17.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner. It is confirmed that this shadow HRA submitted by the applicant has been assessed as being suitable for the Borough Council as competent authority to use as the HRA record for the determination of the planning application, in accordance with the Conservation of Habitats and Species Regulations 2017. In this instance the Borough Council has considered there is no likely significant effect on protected habitats arising solely from the development itself; and the development would contribute to the overall in-combination significant adverse effect identified by the Habitats Regulations Assessment Report for the Local Plan Core Strategy, but this effect can be adequately mitigated by the Habitats Monitoring and Mitigation Strategy; and that Strategy requires a payment of £185.93 per each additional dwelling towards the monitoring and mitigation provided through that Strategy.
18.This development involves works within the public highway that can only be carried out by Norfolk County Council as Highway Authority unless otherwise agreed in writing. It is an OFFENCE to carry out any works within the Public Highway, which includes a Public Right of Way, without the permission of the Highway Authority. Please note that it is the applicant's responsibility to ensure that, in addition to planning permission, any necessary consents or approvals under the Highways Act 1980 and the New Roads and Street Works Act 1991 are also obtained from the County Council. Advice on this matter can be obtained from the County Council's Highway Design and Development Group. Please contact Stuart French on 01603 638070. If required, street furniture will need to be repositioned at the applicant's expense. Public Utility apparatus may be affected by this proposal. Contact the appropriate utility service to reach agreement on any necessary alterations, which have to be carried out at the expense of the developer.
19.NOTES - Please read the following notes carefully:- Great Yarmouth Borough Council has a duty to ensure that roads and streets within the Borough are properly named and that the properties fronting onto them are appropriately numbered. Therefore it is essential that once planning permission has been granted, and prior to the completion of development, the developer/owner applies for an official address. This Authority has adopted the legislation set out in sections 17, 18 and 19 of The Public Health Act 1925. In common with most neighbouring local authorities, Great Yarmouth Borough Council is introducing charging for the street naming and numbering of new developments from the 1st January 2020.
