No.Condition Text
1.Due to the proximity of the extension to the northern boundary, the siting and the scale of the development, the proposal would have an overbearing impact on and dominant relationship with the neighbour to the north. As the extension is proposed to be slightly higher than existing height to the eaves, this also increases the likelihood of significantly overshadowing of the habitable room window to an extent which would be harmful to neighbouring amenity. Any natural light would be lost as the extension as proposed would come forward of the window and be built close to the boundary. The black cladding materials proposed to be used would also be overbearing and cause an over-dominant relationship with the neighbour to the north given its proximity. Parking of several vehicles on the driveway/front garden area of No.26 already reduces the light and outlook from the side window of No. 28. If the extension was allowed it would push all the vehicles forward and would cause further problems to the front of No. 28 comprising the outlook, reducing the daylight, and causing increased disturbance and loss of privacy of a second habitable room window further west. This is contrary to adopted policies CS09, A1 and H9 which seeks to protect the amenity of existing residents.
2.STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
