1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- Required to be imposed pursuant to Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with: 1) the application and drawings received by the Local Planning Authority on 7th March 2022, including location plan, elevations of geodome and Flood Risk Assessment; and 2) the Habitats Regulations Assessment received 26th April 2022 including details of the portacabin; and 3) the Coastal Erosion Vulnerability Assessment received 10th May 2022 The reason for the condition is :- For the avoidance of doubt.
3.The structure hereby approved shall be in place for a maximum of 3 months each year from mid May to mid August during the little tern breeding season. Outside of the season and when no longer required for this purpose the structure shall be removed from the site and the site restored to its prior condition. The reason for the condition is :- For the avoidance of doubt and in the interests of the appearance of the locality.
4.Information regarding the availability of the Environment Agency's "Floodline Warnings Direct" flood warning scheme, shall be made available to future occupiers of the site. The reason for the condition is :- In accordance with the recommendations of the flood risk assessment, to minimise the risk to the occupants in the event of flooding.
5.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner. It is confirmed that this shadow HRA submitted by the applicant has been assessed as being suitable for the Borough Council as competent authority to use as the HRA record for the determination of the planning application, in accordance with the Conservation of Habitats and Species Regulations 2017. In this instance the Borough Council has considered there is no likely significant effect on protected habitats arising solely from the development itself; and the development will help to safeguard the designated special protection area.
6.The proposal meets the criteria outlined in policy CS9 and CS11 in the adopted Core Strategy, GSP4 and GSP5 of Local Plan Part 2 and E1 of the Winterton Neighbourhood Plan .
