1.Dear Sir, Town and County Planning Act 1990 (as amended) The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended) Site: Rectory Farm, Low Road, Matham, GREAT YARMOUTH, NR29 4RE Reference: 06/22/0082/PAD (please quote on all correspondence) Proposal: Prior approval application for proposed change of use of agricultural buildings to 5 no. dwellinghouses. Great Yarmouth Borough Council as a local planning authority, hereby confirm that the above proposal is not considered permitted development under Schedule 2 Part 3 Class Q of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended) because the smaller dwellinghouses proposed would exceed the floor area permitted by paragraph Q.1(c)(bb) - therefore failing to comply with Q.1(c)(bb). The prior notification is therefore refused in line with the procedure under W (3) (a) for the proposed development at the address shown above, as described by the description shown above. The application is located within the orange 400 metres to 2.5km Indicative Habitat Impact Zone there has not been a Shadow Habitats Regulations Assessment or financial contribution to the Council's Habitat Monitoring and Mitigation Strategy (HMMS) provided as part of this application. As such the Local Planning Authority cannot fully assess the additional impact upon the designated sites sites within the Borough, nor is it able to secure the appropriate mitigation. Additional note: please note that notwithstanding that the proposal was not considered to be permitted development, prior approval would have been required under Q.2 to demonstrate that there is no contamination to humans or the environment on site and for location/siting due to a lack of information to demonstrate that the surface water runoff and wastewater generated (which could pollute the Trinity Broads) will be less than that generated by the existing use . Yours faithfully, David Glason Director of Planning and Growth
