1.The development shall be carried out in accordance with the revised plans Silos Floor Plans and Elevations (0728/103), Caravans Floor Plans 03 and Elevations, Location Plan 01 and Site Plan 02 received by the Local Planning Authority on 7.10.2022, and, in relation to the Silos only, Silo Plan Drawing No711/1 dated 17.04.2012 from previous permission 06/11/0815/F. The reason for the condition is:- For the avoidance of doubt.
2.Notwithstanding the provisions of Article 3, Schedule 2, Part 5 Class B of the Town and Country Planning (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification), no development (as may be required in accordance with a site licence under the Caravan Sites and Control of Development Act 1960) shall be carried out without the prior approval in writing of the Local Planning Authority. The reason for the condition is :- To enable the Local Planning Authority to retain control over the development in the interests of the visual amenities of the locality and in the interests of the residential amenities of the occupiers of adjacent property.
3.The occupation of the units of accommodation hereby permitted during the period from 1st March to 30th November in any year shall be limited to persons solely or mainly working in the locality in agriculture during the period from 1st March to 30th November in any year. The units of accommodation hereby permitted may be occupied between the 1st December to the 31st December in any year only by agricultural workers; or non-agricultural workers that are family or friends of the applicant, between the 1st December to the 31st December in any year. The units hereby permitted shall not be occupied whatsoever outside of the dates highlighted above within this condition. The reason for the condition is:- To ensure that the proposed use is carried out in the manner anticipated by the Local Planning Authority.
4.Having regard to the maintenance of living conditions for the seasonal workers occupying the accommodation in accordance with other conditions of the permission, the applicant shall provide to the Local Planning Authority upon request a copy of a valid Gangmaster and Labour Abuse Authority licence (GLAA). If the premises hereby approved are not subject to the GLAA licensing regime, then the applicants/operators of the facility shall upon request from the Local Planning Authority provide evidence that there is a system of regular auditing of the accommodation to ensure that the accommodation provides adequate basic living conditions. The information that would be required by the Local Planning Authority, as a minimum, will identify the dates of regular inspections of all the facilities and evidence that adequate operational laundry, washing, cooking, and heating facilities/provision are available within all units or accessible to all occupants on the site; the number of occupants per bedroom and confirmation that separate eating and living rooms are available. Reason For the Condition:- To ensure that the occupants are able to enjoy a good standard of residential amenity whilst occupying the accommodation in accordance with Policy A1 of the Great Yarmouth Local Plan (2021).
5.A maximum of 80 individuals may reside on the site at any one time in accordance with condition 3 of this permission. A log book detailing the names of all people staying within the approved accommodation shall be maintained at all times and be made available to view upon request by the Local Planning Authority. The reason for the condition is :- To protect amenities of the area.
6.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
7.The response from Environmental Services required the following information to be added to the planning permission: The Gangmaster and Labour Abuse Authority (GLAA) protects workers from exploitation by operating a licensing scheme in agriculture, horticulture, shellfish gathering and associated processing and packaging sectors. If the applicant supplies labour or use workers to provide services in these sectors, then they must apply for a GLAA licence. The GLAA also have powers with regard to condition and suitability of accommodation. Please provide evidence as to whether a GLAA licence will be held in this situation. If a licence is not held please advise how the accommodation is audited to ensure adequate basic living conditions. This will consider adequate facilities for washing, cooking, and heating provision. Also providing information on number of occupants per bedroom and whether separate eating and living rooms are available. In addition, provide information on laundry facilities and security of workers personal belongings.
