| 1. | The development must be begun not later than three years beginning with the date of this permission.
The reason for the condition is :-
The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
| 2. | The development shall be carried out in accordance with the plan 1076/4 Revision A1 received by the Local Planning Authority on 12 September 2022 and the further information supplied regarding indicative types of caravan proposed, received 7 April 2022.
The reason for the condition is :-
For the avoidance of doubt. |
| 3. | During the use of the development hereby permitted, the following restrictions shall apply:
(i) the static caravans shall be used or occupied for holiday purposes only; and,
(ii) the caravans shall not be occupied as a person's sole, or main place of residence; and,
(iii) the owners/operators shall maintain an up-to-date register of the names of all occupiers of individual caravans on the site, and of their
main home addresses, and shall make this information available at all reasonable times to the Local Planning Authority.
The reason for the condition is: -
To ensure that approved holiday accommodation is not used for unauthorised permanent residential occupation. The register required in (iii) above shall normally be collected by the caravan site licence holder or his/her nominated person. |
| 4. | The accommodation units shall be used for holiday purposes only and no unit shall be occupied for more than 28 days at any one time without the prior written approval of the Local Planning Authority.
The reason for the condition is :-
The site is located outside any area allocated in the Great Yarmouth Borough Local Plan Part 2 (2021) for permanent residential development and permanent occupation would therefore be contrary to Policy GSP1 and L1 of the adopted development plan. |
| 5. | (a) The caravans on plots 10, 11, 12 and 13 as shown on plan 1076/4 Revision A1 shall be arranged so that the elevations/facade facing towards the closest residential properties is either glazed with obscure glass to Pilkington level 5, or contains no windows, as identified with notations on the approved plan.
(b) Any areas of decking on any caravan with this development shall be arranged as shown on Plan Number 1076/4 Revision A1. No additional decking or verandahs shall be installed in any part of the development other than in the areas shaded grey on the approved plan.
The reason for the condition is :-
To ensure neighbour privacy and amenity. |
| 6. | There shall be no use or occupation whatsoever of any caravan at Plots 5 to 10 inclusive until a scheme of proposed landscaping enhancement to the south and west boundaries of the site has first been submitted to and approved in writing by the Local Planning Authority.
The scheme of landscaping enhancement shall include indications of all existing trees and hedgerows on the south and west boundaries, details of any to be retained, together with the location of the proposed enhanced planting areas and the native species to be planted in those locations, and their stature and densities of planting. The planting shall be undertaken in its entirety during the first planting season following approval of the written details, and any of the additional planting that fails or dies within 5 years of that planting season shall be replaced.
The reason for the condition is:-
In the interests of the visual amenities of the locality. |
| 7. | There shall be no access for holiday makers to or from the site via the access gate on the northern boundary, in accordance with the annotation shown on plan 1076/4 Revision A1.
The reason for the condition is:-
For the avoidance of doubt and to ensure that access to and from the site is via the existing vehicular access, in the interests of highway safety and neighbouring amenity. |
| 8. | Foul drainage shall not be discharged other than to the foul sewer which has direct mains connection to Caister Water Treatment Works in accordance with the response provided by Mr Redden of Anglian Water on 18 July 2022.
The reason for the condition is:-
In order to effect satisfactory drainage arrangements both on and from the site and to avoid problems of pollution of nearby water courses. |
| 9. | Any verandahs, decking, patios, balconies or fencing to be used in association with any caravan within the development hereby permitted shall be installed only in a colour that matches the colour of the caravan within the plot to which it relates.
The reason for the condition is :-
In the interests of the visual amenity of the area. |
| 10. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
It is confirmed that an HRA screening has been assessed as being suitable for the Borough Council as competent authority to use as the HRA record for the determination of the planning application, in accordance with the Conservation of Habitats and Species Regulations 2017.
In this instance the Borough Council has considered there is no likely effect on protected habitats arising solely from the development because it represents a reduction in numbers of holidaymakers on the site. |
