1.The development to which this permission relates must be begun not later than the expiration of two years from the final approval of the reserved matters or, in the case of approval on different dates, the final approval of the last such matter to be approved. The reason for this condition is:- The time limit condition is imposed in order to comply with the requirements of Section 92 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the following plans and documents: . 3.Unless otherwise agreed in writing by the Local Planning Authority all dwellings shall be constructed in accordance with the schedule of works contained on Drawing No. 1665/1 Rev H regarding: . compliance with Building Regulations Part M Category 2 - accessible and adaptable dwellings; . limiting water consumption to 110 litres per person per day; and . provision of electric vehicle charging points. The reason for the condition is :- To ensure the proper development of the site in making provision for the demand for electric vehicle charging within the lifetime of the development, to ensure homes are designed to be adaptable to meet current and future needs, and to achieve a higher water efficiency standard all in accordance with Policies I1, A2 and E7 of Great Yarmouth Local Plan.
4.If the topsoil from site is to be reused for gardens and landscaping it is recommended that once stripped and stockpiled a representative number of samples are taken and tested for contaminants of concern including Total Sulphate, Boron, Water Soluble, Arsenic, Cadmium, Chromium III, Chromium VI, Copper, Lead, Mercury, Nickel, Selenium, Zinc, Acid Soluble Sulphide, Phenols (Monohydric), Total Cyanide, Elemental Sulphur, pH Value, PAH Total, Speciated PAH, Soil Organic Matter (SOM) to ensure compliance for reuse in a residential setting. The assessment criterion will be residential with the consumption of home grown produce land use with 1% soil organic matter using CLEA v1.06, C4SL's, Atkins ATRISK and LQM/CIEH S4ULs models. If contamination that was not previously identified is found at any time when carrying out the approved development, it must be reported in writing immediately to the Local Planning Authority. All development shall cease and shall not recommence until: 1) a report shall be submitted and agreed in writing by the Local Planning Authority which includes results of an investigation and risk assessment together with proposed remediation scheme to deal with the risk identified and 2) the agreed remediation scheme has been carried out and a validation report demonstrating its effectiveness has been approved in writing by the Local Planning Authority. The reason for the condition is :- To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors in accordance with Policy E6 of Great Yarmouth Local Plan
5.The soft landscaping in the form of tree planting as shown on Drawing No.1665-1 Rev H Site Layout Plan shall be carried out within the first available planting season following the commencement of the development (or in accordance with a programme of planting to be first agreed in writing by the Local Planning Authority). The planting shall be carried out as approved. If within a period of TEN YEARS from the date of planting any tree or plant or any tree or plant planted in replacement for it, is removed, uprooted or is destroyed or dies, (or becomes in the opinion of the Local Planning Authority, seriously damaged or defective) another tree of the same species and size as that originally planted shall be planted at the same place, unless the Local Planning Authority gives its written consent to any variation. The reason for the condition is :- In the interests of the satisfactory appearance of the development in accordance with Policies CS9 and E4 of Great Yarmouth Local Plan and Policy E1 of Rollesby Neighbourhood Plan.
6.The Council in pursuance of powers under this Act also hereby APPROVES the following details (in full or in part) reserved by conditions 3, 7, 8, 15, 20 and 21 imposed on Outline Planning Permission 06/18/0315/O: Condition 3 (Road and Drainage) states - No works shall commence on the site until such time as detailed plans of the roads, footways, street lighting, foul and surface water drainage have been submitted to and approved in writing by the Local Planning Authority. All construction works shall be carried out in accordance with the approved plans. The reason for the condition is :- This needs to be a pre-commencement condition to ensure fundamental elements of the development that cannot be retrospectively designed and built are planned for at the earliest possible stage in the development and therefore will not lead to expensive remedial action and adversely impact on the viability of the development. The access road into the site outside of the highway boundary will be a private maintained road as it is being constructed with permeable block paving as part of the proposed Drainage Strategy and as such will not be adopted by the Highway Authority. The layout of the proposed road has been designed to appropriate width and dimension, with an appropriate turning head. The junction of the new road onto Martham Road will form part of the off-site works required by conditions 10 and 11 of OPP 06/18/0315/O to ensure there is appropriate crossing of the highway to serve the development. No street lighting details have been submitted. An acceptable drainage strategy has been received with foul drainage to the mains sewer and surface water from roofs discharged to crated soakaways in plot curtilages and road, parking and driveway areas drained by permeable paving surface. The following plans and documents are considered to be acceptable and meet the requirements of this condition in part and are hereby approved: . Drawing No.1665-1 Rev H Site Layout Plan . Flood Risk Assessment and Drainage Strategy ref: 125/2022/FRADS Rev P2 dated December 2022 The condition cannot be discharged in full because the construction works shall be carried out in accordance with the approved plans. The development must take place in accordance with the approved details.
7.Condition 7 (Construction Parking) states - Development shall not commence until a scheme detailing provision for on-site parking for construction workers for the duration of the construction period has been submitted to and approved in writing by the Local Planning Authority. The scheme shall be implemented throughout the construction period. The reason for the condition is :- To ensure adequate off-street parking during construction in the interests of highway safety. This needs to be a pre-commencement condition as it deals with the construction period of the development. The following plan is considered to be acceptable and meets the requirements of this condition in part and is hereby approved: . Traffic Management Plan 1665/10 Rev A (Oct. '22) The condition cannot be discharged in full because the scheme as approved shall be implemented throughout the construction period. The development must take place in accordance with the approved details.
8.Condition 8 (Construction Traffic Management Plan) states - Prior to the commencement of any works a Construction Traffic Management Plan and Access Route which shall incorporate adequate provision for addressing any abnormal wear and tear to the highway together with wheel cleaning facilities shall be submitted to and approved in writing by the Local Planning Authority together with proposals to control and manage construction traffic using the 'Construction Traffic Access Route' and to ensure no other local roads are used by construction traffic. The reason for the condition is :- In the interests of maintaining highway efficiency and safety. This needs to be a pre-commencement condition as it deals with safeguards associated with the construction period of the development. The following plan and document are considered to be acceptable and meet the requirements of this condition in part and are hereby approved: . Traffic Management Plan 1665/10 Rev A (Oct. '22) . Construction Traffic Management Plan dated 10 August 2022 Rev A The condition cannot be discharged in full because the scheme as approved shall be implemented throughout the construction period. The development must take place in accordance with the approved details.
9.Condition 15 (Archaeological Site Investigation and Post Investigation Assessment) states - The development shall not be occupied until the site investigation and post investigation assessment has been completed in accordance with the programme set out in the archaeological written scheme of investigation approved under condition 13 and the provision to be made for analysis, publication and dissemination of results and archive deposition has been secured. The reason for the condition is:- In order to enable investigation and recording of this site of archaeological interest to take place during the period of building or engineering works in accordance with the provisions of the National Planning Policy Framework. The following document has addressed the requirements of the condition and is sufficient to discharge Condition 15 in full: . Archaeology Report Number CB722R v.1.1
10.Condition 20 (Surface Water Management Strategy) states - No drainage works shall commence until a surface water management strategy has been submitted to and approved in writing by the Local Planning Authority. No hard-standing areas to be constructed until the works have been carried out in accordance with the strategy. The reason for the condition is:- These details have not been submitted as part of the application and are required to ensure a satisfactory form of development. The following document is considered to be acceptable and meets the requirements of this condition in part and is hereby approved: . Flood Risk Assessment and Drainage Strategy ref: 125/2022/FRADS Rev P2 dated December 2022 The condition cannot be discharged in full because the construction works shall be carried out in accordance with the approved strategy. The development must take place in accordance with the approved details.
11.Condition 21 (Fire Hydrant) states - Prior to the commencement of the development hereby permitted details of 1 no. fire hydrant to be installed on no less than a 90 mm main shall be submitted to and approved by the Local Planning Authority. The hydrant shall be installed in accordance with the approved details prior to occupation of the development. The reason for the condition is:- The condition is a pre-commencement condition to ensure that the development is designed in a way to accommodate the fire hydrant and it is to be installed in the interest of public safety. The following plan and detail contained therein in terms of hydrant, main size and location is considered to be acceptable and meets the requirement of this condition in part and is hereby approved: . Site Layout Plan 1665-1 Rev H The condition cannot be discharged in full because the hydrant works shall be carried out in accordance with the approved plans prior to occupation of the development. The development must take place in accordance with the approved details.
12.NOTES - Please read the following notes carefully:- The Outline Planning Permission 06/18/0315/O, contains a number of compliance Conditions that still require discharge - Condition 10 - Off-site highway improvement works; Condition 12 Traffic Regulation Order (TRO); Condition 18 Ecological Enhancements in the form of bird and bat boxes; and compliance is also required with the following conditions: Condition 2 - compliance with Reserved Matters as approved above Condition 3 - roads and drainage as above Condition 4 - completion of roads and drainage as approved Condition 5 - surfacing of road as approved Condition 6 - visibility splays Condition 7 - on-site parking for construction workers as approved above Conditions 8 and 9 - construction traffic management plan as approved above Conditions 10, 11 and 12 - off site highway works and promotion of TRO Conditions 13, 14 and 15 - Archaeology (has been complied with in full) Condition 16 - boundary wall as shown on Drawing No. 1665/1 Rev H - Site Layout Plan Condition 17 - external lighting details if required Condition 18 - ecology enhancements Condition 19 - boundary treatments as shown on Drawing No. 1665/1 Rev H - Site Layout Plan Condition 20 - surface water drainage as approved Condition 21 - fire hydrant as approved Condition 22 - retention of hedge on eastern boundary Condition 23 - construction work hours Condition 24 - land contamination Condition 25 - site area and maximum number of dwellings Local Air Quality: The site will potentially generate a significant amount of dust during the construction process; therefore, the following measures should be employed: . An adequate supply of water shall be available for suppressing dust. . Mechanical cutting equipment with integral dust suppression should be used. . There shall be no burning of any materials on site, or burial of asbestos, which should instead be removed by an EA licenced waste carrier, and the waste transfer notes retained as evidence. Advisory Note The applicant is strongly recommended to advise neighbouring businesses and residential occupiers of the proposals, including any periods of potentially significant disturbance e.g., demolition or piling, together with contact details in the event of problems. Disclaimer re contamination NOTE: The responsibility for the safe development and secure occupancy of the site rests with the developer. The local planning authority has determined the application based on the information available to it, but this does not mean that the land is free from contamination, or that the land could not be declared Contaminated Land in future.
13.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner. It is confirmed that this shadow HRA submitted by the applicant was assessed at outline (the planning permission) as being suitable for the Borough Council as competent authority to use as the HRA record for the determination of the planning application, in accordance with the Conservation of Habitats and Species Regulations 2017 and the required payment as currently updated has been made enabling this reserved matters decision.
14.It is hereby acknowledged that the application has been accompanied by the appropriate and necessary financial contributions for GIRAMS Habitat Impacts Mitigation amounting to £2,231.16 (12 dwellings x £185.93 per dwelling) received (28 July 2022). In so doing, the Schedule 5 obligation within the associated Section 106 Agreement is satisfied.
