| 1. | The development must be begun not later than three years beginning with the date of this permission.
The reason for the condition is :-
The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
| 2. | The development shall be carried out in accordance with the revised plan reference 3817 PL01 revision A received by the Local Planning Authority on 06th June 2022
The reason for the condition is :-
For the avoidance of doubt. |
| 3. | Notwithstanding the provisions of the Town and Country Planning Use Classes Order 1987 (or any Order revoking or re-enacting that Order) the premises shall not at any time be used for commercial purposes, either as a holiday let or for the storage of boats let out for use on the lake for commercial purposes. The boathouse shall remain as an ancillary use and building to the main residence known as Hopton Manor.
The reason for the condition is:-
To retain control over the use of the building, and in the interests of protecting residential amenity, to ensure activities are appropriate to its remote and unsustainable location where a new residence would be contrary to policy and commercial use could give rise to disturbance to nearby residents. |
| 4. | No development shall take place (including demolition ground works, vegetation clearance) until a Construction Environmental Management Plan (CEMP: Biodiversity) has first been submitted to and approved in writing by the Local Planning Authority. The CEMP will include mitigation as found in section 7 of the PEA.
The CEMP shall include the following:
- Risk assessment of potentially damaging construction activities;
- Identification of 'biodiversity protection zones';
- Practical measures (both physical measures and sensitive working practices) to avoid or reduce impacts during construction;
- The location and timing of sensitive works to avoid harm to biodiversity features;
- The times during construction when specialist ecologists need to be present on site to oversee works;
- Responsible persons and lines of communication;
- The role and responsibilities on site of an ecological clerk of works (ECoW) or similarly competent person;
- Use of protective fences, exclusion barriers and warning signs.
The approved CEMP: Biodiversity shall be adhered to and implemented through the construction phases strictly in accordance with the approved details, unless agreed in writing by the local planning authority.
The reason for the condition is :-
To mitigate any adverse impacts on biodiversity in line with BS42020:2013 D4.1 and local policy CS11. |
| 5. | No development shall take place (including demolition ground works, vegetation clearance) until a Landscape and Ecological Management Plan (LEMP) has first been submitted to, and approved in writing by, the Local Planning Authority. The LEMP will include such enhancements that are outlined in section 7 of the PEA.
The content of the LEMP shall include the following:
a) Description and evaluation of features to be managed.
b) Ecological trends and constraints on site that might influence management.
c) Aims and objectives of management.
d) Appropriate management options for achieving aims and objectives.
e) Prescriptions for management actions.
f) Preparation of a work schedule (including an annual work plan capable of being rolled forward over a five-year period).
g) Details of the body or organization responsible for implementation of the plan.
h) Ongoing monitoring and remedial measures.
The LEMP shall also include details of the legal and funding mechanism(s) by which the long-term implementation of the plan will be secured by the developer with the management body(s) responsible for its delivery. The plan shall also set out (where the results from monitoring show that conservation aims and objectives of the LEMP are not being met) how contingencies and/ or remedial action will be identified, agreed and implemented so that the development still delivers the fully functioning biodiversity objectives of the originally approved scheme. The approved plan will be implemented in accordance with the approved details.
The reason for the condition is :-
To secure biodiversity enhancements and their on-going management in line with BS42020:2013 D4.5 and local policy CS9 and CS11. |
| 6. | No development shall take place (including demolition ground works, vegetation clearance) until a 'lighting design strategy for biodiversity' has first been submitted to and approved in writing by the Local Planning Authority. Section 7.7 iii in the PEA statement makes recommendations to this effect.
The strategy shall:
(a) Identify those areas/features on site that are particularly sensitive for bats and that are likely to cause disturbance in or around their breeding sites and resting places or along important routes used to access key areas of their territory, for example foraging;
and
(b) Show how and where external lighting will be installed (through the provision of appropriate lighting contour plans and technical specifications) so that it can be clearly demonstrated that areas to be lit will not disturb or prevent the above species using their territory or having access to breeding sites, resting places or feeding areas.
All external lighting shall be installed in accordance with the specifications and locations set out in the strategy, and these shall be maintained thereafter in accordance with the strategy. Under no circumstances should any other external lighting be installed without prior consent from the Local Planning Authority.
The reason for the condition is :-
To mitigate the impact of the development on nocturnal creatures. |
| 7. | There shall be no use of the boathouse until further details of replacement trees for the two trees to be removed have first been provided to and approved in writing by the Local Planning Authority. The siting of the new trees should take into account the competitive impact of existing trees on the replacements and position the new trees to ensure their survival. Written agreement of the Local Planning Authority shall be obtained and the new trees placed within the first planting season following the existing tree's removal (the planting season being between 01 October and 01 April), unless otherwise agreed in writing with the Local Planning Authority. The planting specification shall include planting with stakes, and the specimen to be planted shall be as follows:
Species: To be agreed, Common Alder suggested by arborist.
Size: container grown minimum 50litre, measuring a minimum of 2.0m tall up main stem from ground level and a stem diameter of 12-14cm or greater
Trees to be planted and maintained thereafter in accordance with British Standard BS8545 Trees: from nursery to independence in the landscape - Recommendations, Chapters 8 and 9 thereof.
The reason for the condition is :-
To ensure an acceptable standard of planting and maintenance, thereby maximising the successful establishment of the replacement trees. |
| 8. | Before installation of the south wall to the balcony, further details of the manner in which this is constructed shall be submitted to demonstrate air tight construction.
The reason for the condition is :-
To demonstrate the effectiveness of the barrier in reducing noise transmission. |
