1.The proposed first floor extension would be located close to the boundary to no.4 Filby Road and due to the length and massing of the proposed extension it would create an unacceptable impact on the neighbours to the east, creating an overbearing relationship and overdominant appearance, resulting in an increased sense of enclosure, loss of daylight and overshadowing to the rear windows of the adjoining property, particularly to the upstairs window closest to the boundary which would be harmful to the amenity of occupants in that room. This is contrary to the aims of adopted Core Strategy Policy CS09 F and adopted Local Plan Part 2 Policies A1 and H9 part B which seek to protect neighbouring amenity.
2.The application includes a balcony at first floor level to the rear and, whilst views of the end of the garden are already possible from first floor bedroom windows, the new balcony would offer views backwards towards no.2 Filby Road to the west, affording views into their more private immediate rear garden area and into the rear windows of the neighbouring dwelling. This would cause an unacceptable loss of privacy and harm to neighbouring amenity. This is contrary to the aims of adopted Core Strategy Policy CS09 F and adopted Local Plan Part 2 Policies A1 and H9 part B which seek to protect neighbouring amenity.
3.STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
