1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is:- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the application form and approved plans, drawing references: - Site Plan - 02 - Location Plan - 03 - Proposed Elevation and Floor Plans - 002 Received by the Local Planning Authority on 15th November 2021. The reason for the condition is:- For the avoidance of doubt.
3.The development hereby permitted shall be used for holiday purposes only and as holiday accommodation it shall not be occupied for any more than 28 consecutive days at any one time without the express written permission of the Local Planning Authority. There shall be no use of the development hereby permitted as either the primary or permanent residential accommodation of any persons at any time. The reason for the condition is :- The site is in a location considered to be unsuitable for residential use, being outside the defined development limits. The restriction is imposed to ensure the holiday unit is not used as permanent residential accommodation.
4.The owner of the holiday accommodation, shall maintain at all times a register of the occupants of the holiday accommodation that can be examined upon request at any reasonable time by representatives of the Local Planning Authority. The register shall include the name of the occupant and their main postal address. The reason for the condition is :- To ensure the holiday unit is not used as permanent residential accommodation.
5.There shall be no use or occupation of the development hereby permitted until a visitor information pack has been prepared for use at the property to include details of alternative walking sites and details about the importance and vulnerabilities of the nearby Natura 2000 sites. The information shall be made available to all visitors to the premises. The reason for the condition is :- To protect the Natura 2000 sites in accordance with CS11.
6.REASON FOR APPROVAL OF THE APPLICATION :- The proposal meets the criteria set out in core policies CS08, CS09 and CS11 of the adopted Core Strategy and is consistent with policies L2 and A1 of the adopted Local Plan Part 2.
7.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
8.The proposal has been assessed and is in accordance with the adopted development plans, however this permission does not allow any approval or compliance with Building Regulations. Building Control have been consulted as apart of the process and has confirmed the holiday accommodation is non-compliant with Building Regulations. The non-compliance of Building Regulations was not considered a reason for refusal of the Planning Permission only because these are separate legislation regimes requiring both to be satisfied.
