1.The development must be completed within a period of 3 years starting with the date prior approval is granted. The developer must notify the local planning authority of the completion of the development as soon as reasonably practicable after completion. The reason for the condition is :- To comply with the provisions of Class Q
2.The development, including external materials, shall be carried out in accordance with the following revised plans received by the Local Planning Authority on the 24th February 2022: Location plan: A20-0002-001 Rev B Proposed Block & Layout Plan: A20-0002-003 Rev D Proposed Elevations: A20-0002-004- Rev A The reason for the condition is:- For the avoidance of doubt.
3.No occupation of the dwellings hereby permitted shall occur until such a time that the full remediation works recommended in the Phase 2 Report have been completed in their entirety. For the avoidance of doubt, this includes: - All topsoil must be removed from areas of proposed garden and soft landscaping in the south of the site. If soil is imported to the site to bring the affected areas back to a finished level or to provide topsoil, this is required to be 'suitable for use'. Source removal involves the complete removal of contaminated soil. -If water supply pipes are in contact with made ground, then they should be upgraded to barrier pipes in agreement with the local water utility provider. The reason for the condition is :- To ensure that the site is safe for human habitation.
4.There shall be no occupation of the dwellings hereby permitted until the demolition of the central part of the southern building has taken place and all associated materials have been removed from site. The reason for the condition is :- In the interests of providing adequate levels of light and ventilation for the occupants of dwellings 1 and 2 and to provide adequate parking provision.
5.Notwithstanding the provision of the Town and Country Planning (General Permitted Development) Order (2015), (or any Order revoking, amending or re-enacting that Order) no gates/bollard/chain/other means of obstruction shall be erected across the approved access unless details have first been submitted to and approved in writing by the Local Planning Authority. The reason for the condition is: - In the interests of highway safety.
6.Prior to the first occupation of the development hereby permitted a 2.4 metre wide parallel visibility splay (as measured back from the near edge of the adjacent highway carriageway) shall be provided across the whole of the site's roadside frontage as outlined in blue on the submitted details.The splay shall thereafter be maintained at all times free from any obstruction exceeding 1.0 metres above the level of the adjacent highway carriageway. The reason for the condition is: - In the interests of highway safety in accordance with the principles of the NPPF.
7.In the event that contamination that was not previously identified is found at any time when carrying out the approved development, it must be reported in writing immediately to the Local Planning Authority. All development shall cease and shall not recommence until: 1) a report has been submitted and agreed in writing by the Local Planning Authority which includes results of an investigation and risk assessment together with proposed remediation scheme to deal with the risk identified and 2) the agreed remediation scheme has been carried out and a validation report demonstrating its effectiveness has been approved in writing by the Local Planning Authority. The reason for the condition is :- To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors.
8.Construction work shall not take place outside the following hours:- 08:00 to 18:00 Mondays 08:00 to 18:00 Tuesdays 08:00 to 18:00 Wednesdays 08:00 to 18:00 Thursdays 08:00 to 18:00 Fridays 08:30 to 13:30 Saturdays and no work shall take place on Sundays or Bank Holidays. (These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property) The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings.
9.Should an occupied bird nest or a nest in the process of being constructed be encountered during works (including barn owl nests) , clearance must cease and shall only recommence when authorised by the supervising ecologist. The reason for the condition is :- To comply with the Wildlife and Countryside Act 1981, as amended (section 1), which states that it is an offence to remove, damage or destroy the nest of any wild bird while the nest is in use or being built.
10.No occupation of the dwellings hereby approved shall occur until at least 1 barn owl box has first been installed within the site in its entirety. The owl box shall be retained in the approved form in perpetuity thereafter. The reason for the condition is :- To secure biodiversity enhancements in line with the NPPF.
11.No occupation of the dwellings hereby approved shall occur until at least 2 sparrow terrace boxes per dwelling have first been installed in their entirety. The bird boxes shall be retained in the approved form in perpetuity thereafter. The reason for the condition is :- To secure biodiversity enhancements in line with the NPPF.
12.NOTES - Please read the following notes carefully:- The site will potentially generate a significant amount of dust during the conversion process; therefore, the following measures should be employed: - - An adequate supply of water shall be available for suppressing dust; - Mechanical cutting equipment with integral dust suppression should be used; - There shall be no burning of any materials on site.
13.NOTES - Please read the following notes carefully:- The applicant is reminded that they have a legal duty to remove most Asbestos Containing Materials (ACMs) before development and some ACMs must be removed by contractors licensed by the Health and Safety Executive. If at any stage during the development asbestos is suspected the work should be stopped and the material investigated.
14.NOTES - Please read the following notes carefully:- Advisory Note The applicant is strongly recommended to advise neighbouring businesses and residential occupiers of the proposals, including any periods of potentially significant disturbance e.g. demolition or piling, together with contact details in the event of problems.
15.NOTES - Please read the following notes carefully:- Disclaimer re contamination NOTE: The responsibility for the safe development and secure occupancy of the site rests with the developer. The local planning authority has determined the application on the basis of the information available to it, but this does not mean that the land is free from contamination, or that the land could not be declared Contaminated Land in future.
16.NOTES - Please read the following notes carefully:- Occasionally European protected species, such as bats, can be found during the course of the development. In the event that this occurs, it is advised that the developer stops work immediately and seeks the advice of a suitably qualified ecological consultant.
17.NOTES - Please read the following notes carefully:- The applicant is reminded that, under the Wildlife and Countryside Act 1981, as amended (section 1), it is an offence to remove, damage or destroy the nest of any wild bird while the nest is in use or being built. Planning consent for a development does not provide a defense against prosecution under this act. While trees and scrub are likely to contain nesting birds between 1st March and 31st August inclusive buildings can also support nesting birds. If works occur during the nesting period a careful check of the building by a competent ecologist should be undertaken to assess the nesting bird activity on the site during this period and has shown it is absolutely certain that nesting birds are not present.
