1.The hedgerow removal works hereby permitted must be undertaken not later than two years beginning with the date of this permission. If you wish to carry out the removal after this date you must submit a new Hedgerow Removal Notice. The reason for the condition is :- To ensure the works are undertaken in the timescales required by the Hedgerow Regulations 1997.
2.You must remove only as much hedge as indicated on the approved Hedgerow Removal Notice plans specified on this notice. If you intend to take out more than the area shown, you must submit a new Hedgerow Removal Notice application. Reason: For the avoidance of doubt and in accordance with the Hedgerow Regulations 1997.
3.The development must be carried out in strict accordance with the documents detailed below: a) Location marked on the Hedge Removal Area (7m long) plan, received by the Local Planning Authority on 19 October 2021. b) Location marked within the Hedgerow Removal Sketch Plan, received by the Local Planning Authority on 21 October 2021. c) Ecology Report, Wild Frontier Ecology, Rev 3, dated 03 May 2021. Reason: For the avoidance of doubt and in the interests of proper planning.
4.The development must be carried out in strict accordance with the Ecological Appraisal Report ref. SEW-11465 Rev.3 (dated 03 May 2021) 'Billockby New Pumping Station' by Wild Frontier Ecology. Reason: To ensure the protection of existing trees and remainder of the hedging and to ensure adequate replacements, and in the interest of the amenity of the area.
5.The length of hedgerow to be removed shall be replaced within the first available planting season following removal, with a suitable mixture of native hedgerow species which shall be planted in accordance with the details proposed in Figure 7 of the submitted Ecological Appraisal Report ref. SEW-11465 Rev.3 (May 2021) 'Billockby New Pumping Station'. The replacement planting should be provided to the same specification as that to be provided pursuant to pumping station permission FUL/2020/0091 which shall be undertaken no later than those replacements are provided or the first use of the pumping station, whichever is the earlier. Reason: To ensure the adequate replacement hedge planting, and in the interest of the amenity of the area.

7.The applicant is reminded that the following precautions must be followed as part of the works hereby permitted (as set out within section 7.2 of the submitted Ecological Appraisal Report ref. SEW-11465 Rev.3 (May 2021) 'Billockby New Pumping Station'): (1) Hedge removal should only occur outside of the main breeding season which runs from 1st March to 31st August inclusive. If this is not possible and clearance must take place during those months, a nesting bird check must be carried out by a suitably qualified ecologist prior to works commencing. Clearance can only then proceed if the vegetation has been confirmed to be devoid of active nests. If any active nests are found they must be allowed to reach a natural conclusion without disturbance and a suitable Construction Exclusion Zone will need to be employed. (2) Site clearance and construction activities should only take place in daylight hours, so as to limit the potential for direct harm to nocturnal animals such as badgers, bats, amphibians and small terrestrial animals such as hedgehogs. (3) During the works, any piles of waste or construction material should be stored off the ground, such as in skips or on pallets, to reduce the possibility of small animals taking refuge under/amongst them.
8.NOTES: - Safety & Quality: Hedgerow removal is a skilled and potentially dangerous task. You are strongly advised to seek the services of a competent tree surgeon that holds the appropriate equipment, insurance, training and valid qualifications. Find an Arboricultural Association Approved Contractor at www.trees.org.uk. - Birds: All nesting birds, their nests, eggs and young are protected by law and it is an offence to: i. Intentionally kill, injure or take any wild bird ii. Intentionally take, damage or destroy the nest of any wild bird whilst it is in use or being built iii. Intentionally take or destroy the egg of any wild bird iv. Intentionally (or recklessly in England and Wales) disturb any wild bird listed on Schedule 1 while it is nest building, or at a nest containing eggs or young, or disturb the dependent young of such a bird. The maximum penalty that can be imposed - in respect of a single bird, nest or egg - is a fine of up to £5000, six months imprisonment or both. The applicant is therefore reminded that it is an offence to remove or undertake work on any hedge, tree or building where a nest is in use or being built (usually between late February and late August or late September in the case of swifts, swallows or house martins). If a nest is discovered while work is being undertaken, all work must stop and advice sought from an appropriate professional. - Bats: Bats can live or roost in trees. It is an offence for any person to: i. Intentionally kill, injure or take any bats ii. Intentionally or recklessly damage, destroy or obstruct access to any place that a bat uses for shelter or protection. This is taken to mean all bat roosts whether bats are present or not. Under The Habitats Regulations 2017 it is an offence to damage or destroy a breeding site or resting place of any bat. This is an absolute offence - in other words, intent or recklessness does not have to be proved. The applicant is therefore reminded that it is an offence to disturb bats in any way unless a licence has been obtained from Natural England. If a bat is discovered while work is being undertaken all work must stop and advice sought from an appropriately qualified professional.
