1.Condition 3 states: Prior to the commencement of the development and as contamination is suspected to exist, following a Phase 1 investigation, a Phase 2 site investigation is to be carried out to the satisfaction of the Environmental Services Manager. If the Phase 2 site investigation determines that the ground contains contaminants at unacceptable levels then the applicant is to submit a written strategy detailing how the site is to be remediated to a standard suitable for its proposed end-use to the Environmental Services Manager. No buildings hereby permitted shall be occupied until the remediation works agreed within the scheme have been carried out to the satisfaction of the Local Planning Authority. The reason for the condition is :- To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors. Following submission of Phase 1 and Phase II Site Investigations - the report recommended no further intrusive investigation for contamination purposes and one further monitoring visit for gas. Supplementary Gas Monitoring result letter dated 3 December 2021 indicates these are considered sufficient to discharge the condition in full as ground gas monitoring has confirmed the absence of ground gas. The condition is therefore discharged in full.
2.Condition 5 states: No works shall commence on the site until such time as detailed plans of the roads, footways, street lighting, foul and surface water drainage have been submitted to and approved in writing by the Local Planning Authority. All construction works shall be carried out in accordance with the approved plans. The reason for the condition is :- This needs to be a pre-commencement condition to ensure fundamental elements of the development that cannot be retrospectively designed and built are planned for at the earliest possible stage in the development and therefore will not lead to expensive remedial action and adversely impact on the viability of the development. 3.Condition 8 states: Prior to the commencement of any works a Construction Traffic Management Plan and Access Route which shall incorporate adequate provision for addressing any abnormal wear and tear to the highway together with wheel cleaning facilities and on-site parking for construction workers shall be submitted to and approved in writing by the Local Planning Authority together with proposals to control and manage construction traffic using the 'Construction Traffic Access Route' and to ensure no other local roads are used by construction traffic. The reason for the condition is :- In the interests of maintaining highway efficiency and safety. This needs to be a pre-commencement condition as it deals with safeguards associated with the construction period of the development. The following Plan is approved by the Local Planning Authority - . MART-CIV-001 Rev B Construction Management Plan As such the requirement to provide submitted details for Condition 8 has been fully discharged as sufficient information to discharge the condition has been submitted and is approved. The development must be undertaken in accordance with the plan listed above.
4.Condition 10 states: The outline permission for the site this development is accessed off (06/18/0149/O) requires a scheme of off-site highway improvements in accordance with condition 20 of that permission which read: Notwithstanding the details indicated on the submitted drawings no works above slab level shall commence on site unless otherwise agreed in writing until detailed drawings for the off-site highway improvement works as indicated on Drawing Nos 388861-MMD-RR-00-DR-C-0001-P4 and 388861-MMD-RR-00-DR-C-003 have been submitted to and approved in writing by the Local Planning Authority. No works therefore on this permission shall proceed beyond floor slab level until the scheme of off site highway works related to the above condition have been submitted and approved. The works agreed shall be implemented and made available for use before occupation of any dwelling, and shall be maintained in the approved condition. 5.Condition 11 states: Before works have progressed beyond damp proof course level, further details of the means by which the northern boundary of the site shall be further planted to strengthen and add to the existing hedgerow screen shall be submitted in written and drawn form to the local planning authority and subsequently agreed by the LPA. The works shall be carried out within the first planting season following completion of the building shells and any plants that die within the first five years shall be replaced to the satisfaction of the local planning authority The reason for the condition is :- To ensure the development is well screened within the landscape. The following plan is approved by the Local Planning Authority - . 2551 - 21A Rev 3 Soft Landscaping Proposal As such the requirement to provide submitted details for Condition 11 has been fully discharged as sufficient information to discharge the condition has been submitted and is approved. The development must be undertaken in accordance with the plan listed above.
6.Condition 12 states: Before construction proceeds beyond damp proof course level further details of the means to secure wildlife mitigation measures in accordance with the recommendations set out in the Norfolk Wildlife Services "Preliminary Environmental Assessment" ( PEA) reference 2019.182, including the establishment of on site walking routes into the adjoining site and beyond to Martham. The reason for the condition is :- To ensure wildlife mitigation measures are incorporated into the scheme The following plans are approved by the Local Planning Authority - . 2551 - 21A Rev 3 Soft Landscaping Proposal . 2551 - 21B Rev 3 Soft Landscaping Proposal . 2551 - 21C Rev 3 Soft Landscaping Proposal As such the requirement to provide submitted details for Condition 12 has been fully discharged as sufficient information to discharge the condition has been submitted and is approved. The development must be undertaken in accordance with the plans listed above.
7.Condition 13 states: Before works to install ducts in the carriageway for street and any other external lighting is implemented, further details of a scheme of lighting shall be submitted to and approved by the local planning authority. The agreed scheme shall be implemented before occupation and retained thereafter in the approved form. To ensure sufficient lighting for highway safety and to deter crime, whilst ensuring wildlife (especially nocturnal) is not adversely affected by development. This condition is discharged in full by the letter from Norfolk County Council Highways dated 9 July 2021 confirming that Martham Parish Council do not require street lighting on this development.
8.Condition 14 states: Before works to install underground ducts for electric vehicle charging facilities is implemented, further details of a scheme of ducts shall be submitted to and approved by the local planning authority. The agreed scheme shall be implemented before occupation and retained thereafter in the approved form. The reason for the condition is :- To ensure sufficient provision for electric vehicle charging especially in common parking areas. The following plan is approved by the Local Planning Authority - . MART-CIV-002 Electric Vehicle Provision Plan As such the requirement to provide submitted details for Condition 14 has been fully discharged as sufficient information to discharge the condition has been submitted and is approved. The development must be undertaken in accordance with the plan listed above.
9.Condition 15 states: Prior to commencement of development, in accordance with the Flood Risk Assessment Addendum (ASD Ref: 1403/FRAA/07-20 Rev A dated August 2020) detailed designs of a surface water drainage scheme incorporating the following measures shall be submitted to and agreed with the Local Planning Authority. The approved scheme will be implemented prior to the first occupation of the development. The scheme shall address the following matters: I. Detailed infiltration testing in accordance with BRE Digest 365 (or equivalent) along the length and proposed depth of the proposed infiltration basins. II. Provision of surface water storage, sized and designed to accommodate the volume of water generated in all rainfall events up to and including the critical storm duration for the 1% annual probability rainfall event including allowances for climate change. III. The design of the infiltration basins will incorporate an emergency spillway and any drainage structures include appropriate freeboard allowances. IV. Finished ground floor levels of properties are a minimum of 300mm above expected flood levels of all sources of flooding or 150mm above ground level, whichever is the more precautionary. The reason for the condition is :- To prevent flooding in accordance with National Planning Policy Framework paragraph 163,165 and 170 by ensuring the satisfactory management of local sources of flooding surface water flow paths, storage and disposal of surface water from the site in a range of rainfall events and ensuring the SuDS proposed operates as designed for the lifetime of the development. The surface water drainage scheme is a combination of onsite and offsite highway drainage under a S38 Agreement and onsite permeable paving and private / shared soakaway drainage to be privately maintained. The following document and related plans and details are approved by the Local Planning Authority - . Flood Flood Risk Assessment Addendum Revision B Ref: 1403/FRAA/06-22 Rev B dated June 2022 incorporating surface water drainage scheme and maintenance and management of surface water drainage features as amended by revised Impermeable Area Plan (Appendix L) drawing no. 1403/DRA/016 Rev C and revised Micro Drainage Calculations for X2 soakaway system dated 01/09/2022 (Appendix M). As such the requirement to provide submitted details for Condition 15 has been fully discharged as sufficient information to discharge the condition has been submitted and is approved. The development must be undertaken and maintained in accordance with the approved document referred to above and the relevant plans and details contained within the following supporting appendices as amended : - .
