1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the revised plan 21.10.02 revision A received by the Local Planning Authority on 21 September 2021. The materials to be used in the development hereby permitted shall be in accordance with the details proposed in the submitted application form. The reason for the condition is :- For the avoidance of doubt.
3.No works of demolition shall commence on site until a destructive asbestos survey of buildings to be demolished has first been submitted to and approved in writing by the Local Planning Authority. Development shall not be carried out other than in accordance with the approved details. The reason for the condition is:- Details are required to be submitted prior to commencement of works to ensure that risks from asbestos to the environment, future users of the land and neighbouring land are minimised, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other off-site receptors.
4.Prior to the commencement of the development, a Phase 1 contamination report shall be carried out to assess whether the land is likely to be contaminated and shall be submitted to and approved in writing by the Local Planning Authority prior to any commencement of development. The report shall also include details of known previous uses and possible contamination arising from those uses. If contamination is suspected to exist, a Phase 2 site investigation is to be carried out to the satisfaction of the Local Planning Authority, to also be submitted to and approved in writing by the Local Planning Authority before any construction works commence. If the Phase 2 site investigation determines that the ground contains contaminants at unacceptable levels then the applicant is to submit a written strategy detailing how the site is to be remediated to a standard suitable for its proposed residential end-use, to the Local Planning Authority. The dwelling hereby permitted shall not be occupied until the remediation works agreed within the scheme have been carried out to the satisfaction of the Local Planning Authority. The reason for the condition is :- To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors.
5.In the event that contamination that was not previously identified is found at any time when carrying out the approved development, it must be reported in writing immediately to the Local Planning Authority. All development shall cease and shall not recommence until: 1) a report has been submitted and agreed in writing by the Local Planning Authority which includes results of an investigation and risk assessment together with proposed remediation scheme to deal with the risk identified and 2) the agreed remediation scheme has been carried out and a validation report demonstrating its effectiveness has been approved in writing by the Local Planning Authority. The reason for the condition is :- To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors.
6.Before any work including demolition proceeds, the following precautionary impact avoidance measures shall be employed to minimise the very small risk of reptile presence during site vegetation clearance to encourage them to move away from those areas affected by development and construction, as follows: - All vegetation on the eastern boundary should be strimmed down to 100mm above ground level, with the direction of strim being west to east, with cut material removed from the site. - After 24-48 hours have elapsed, vegetation should be cut to 50mm above ground level in the same direction, and cut material raked off and removed from the site. - All work as set out below must take place during warm, dry, sunny conditions, with a minimum air temperature of 12oC. - Vegetation must be maintained at ground level until groundworks can commence. In accordance with section 6.2.2 of the submitted preliminary environmental assessment (PEA) The stand of Russian vine shall be controlled and eradicated by the applicant by means of mowing/strimming, to be carried out in accordance with section 5.1. The reason for the condition is :- This site is adjacent to a SSSI and for the general benefit of ecology and reptiles in particular.
7.The principal contractor shall adhere to all the following requirements for control of potentially hazardous substances during demolition, ground work and construction, including, but not limited to, the measures listed herein: 1. All fuel/oil storage and transfer, availability of spill kits, storage, use and clean up of cementitious substances, contaminated water and waste materials shall adhere to relevant British Standards and shall follow an on-site management plan. 2. Habitats adjacent to and just beyond the boundaries of the site shall not be illuminated, either directly or via light spill from adjacent buildings during the works. 3. Before any demolition occurs, site fencing shall be erected at a distance of 4m from the east boundary to keep the works and materials storage clear of the east boundary. 4. Works shall not occur during periods of prolonged severe cold winter weather; and, 5. Works shall not be undertaken during the bird breeding season. The reason for the condition is :- For the protection of sensitive European sites and nationally important designated sites for ecology and to protect bats within the area, and for the maintaining of dark skies. (Note the hours of construction work restriction condition means overnight working will be limited)
8.Construction work shall not take place outside the following hours:- 08:00 to 18:00 Mondays 08:00 to 18:00 Tuesdays 08:00 to 18:00 Wednesdays 08:00 to 18:00 Thursdays 08:00 to 18:00 Fridays 08:30 to 13:30 Saturdays and no work shall take place on Sundays or Bank Holidays. (These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property) The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings.
9.No occupation or use of the development hereby permitted shall occur until habitat enhancement measures have first been provided in accordance with section 6.2.1 of the submitted preliminary environmental assessment (PEA) with replacement garden planting selected from the palette of plants set out in the table of the referenced section of the PEA. The habitat improvement measures shall thereafter be retained and maintained as described in the PEA. The reason for the condition is :- To provide an early and late-season nectar source for invertebrates and thus benefit foraging bats and berries for migratory bird species.
10.No occupation or use of the development hereby permitted shall occur until small-scale species enhancement measures have first been installed in accordance with section 6.3.1 of the submitted preliminary environmental assessment (PEA), with two sparrow terrace nest-boxes fixed beneath the eaves of the new building. The nesting boxes shall thereafter be retained and maintained in perpetuity. The reason for the condition is :- To enhance ecology within the site in accordance with the NERC Act.
11.Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any order revoking and re-enacting the order) no extensions shall be built or windows inserted into the walls or roof of the building(s) without first obtaining the express written permission of the Local Planning Authority. The reason for the condition is:- In the interests of the residential amenities of the occupiers of the adjacent property.
12.Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any order revoking and re-enacting the order) no exterior lighting shall be installed in the curtilage or on the building without first obtaining the express written permission of the Local Planning Authority. The reason for the condition is:- In the interests of the residential amenities of the occupiers of the adjacent property, dark skies and ecology.
13.NOTES - Please read the following notes carefully:- Occasionally protected species, such as bats, can be found during the course of development even when the site appears unlikely to support them or after an ecological survey has found no previous evidence of them. In the event that this occurs, it is advised that the developer stops work immediately and seeks the advice of a suitability qualified ecological consultant.
