1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the plans received by the Local Planning Authority on the 21st June 2021: Existing and proposed elevations, floor plans and block plan: GJ/21/1985 04 Proposed garage elevations and floor plan and site location plan: GJ/21/1985 05 The reason for the condition is:- For the avoidance of doubt.
3.The existing dwelling (as indicated on the existing site plan within submitted plan GJ/21/1985 04 received by the Local Planning Authority on the 21st June 2021) shall be demolished and all associated materials removed from site prior to the commencement of any works on the replacement dwelling. The reason for the condition is :- To enable the Local Planning Authority to retain control over the development in the interests of the visual amenities of the locality.
4.No development shall take place until the following information has been submitted to and approved in writing by the Local Planning Authority: (i) a full site survey showing: the datum used to calibrate the site levels levels along all site boundaries levels across the site at regular intervals floor levels of adjoining buildings (ii) full details of the proposed finished floor levels of all buildings and hard surfaces. The development shall be carried out only in accordance with the approved details. No development shall take place until full details of the finished levels, above ordnance datum, of the ground floor(s) of the proposed building(s), in relation to existing ground levels have been submitted to and approved by the Local Planning Authority. The development shall be carried out in strict accordance with the levels approved. The reason for the condtions is:- To ensure that the development takes place in the manner contemplated by the Local Planning Authority and to retain control over any significant changes in levels within the site.
5.No work shall commence until the exact types and colours of the materials have been submitted to and approved by the Local Planning Authority. The development shall be carried out using the agreed materials. The reason for the condition is :- In the interests of the visual amenities of the area as precise details of the materials have not been submitted.
6.No works shall commence on site, other than demolition and site clearance, until details of a surface water drainage system has been submitted to and approved in writing by the Local Planning Authority. Prior to the occupation of the dwelling, the surface water management scheme shall be installed in accordance with the approved details. The reason for the condition is:- To ensure the adequate provision of surface water drainage and in the interests of ensuring no harm is caused to the integrity of the cliff.
7.No occupation of the dwelling hereby permitted shall occur until there has been submitted to and approved in writing by the Local Planning Authority a scheme of landscaping, which shall include indications of all existing trees and hedgerows on the land, and details of any to be retained, together with measures for their protection in the course of development. The development shall thereafter be undertaken in accordance with the details approved. The reason for the condition is:- In the interests of the visual amenities of the locality.
8.All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the dwelling, and any trees or plants which within a period of 5 years from the planting within the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless the Local Planning Authority gives written consent to any variation. The reason for the condition is:- In the interests of the visual amenities of the locality.
9.No works above slab level shall commence until details of no less than 2no. bird boxes are submitted to and approved in writing by the Local Planning Authority. Prior to the first occupation of the dwellings, the development shall be carried out in accordance with these details and the bird boxes shall remain in perpetuity. The reason for the condition is :- To secure biodiversity enhancements in line with the NPPF.
10.No occupation of the dwelling hereby permitted shall occur until the proposed access and on-site car parking area shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan and retained thereafter available for that specific use. The reason for the condition is: - To ensure the permanent availability of the parking/manoeuvring areas, in the interests of satisfactory development and highway safety.
11.Construction work shall not take place outside the following hours:- 08:00 to 18:00 Mondays 08:00 to 18:00 Tuesdays 08:00 to 18:00 Wednesdays 08:00 to 18:00 Thursdays 08:00 to 18:00 Fridays 08:30 to 13:30 Saturdays and no work shall take place on Sundays or Bank Holidays. (These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property) The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings.
12.In the event that contamination that was not previously identified is found at any time when carrying out the approved development, it must be reported in writing immediately to the Local Planning Authority. All development shall cease and shall not recommence until: 1) a report has been submitted and agreed in writing by the Local Planning Authority which includes results of an investigation and risk assessment together with proposed remediation scheme to deal with the risk identified and 2) the agreed remediation scheme has been carried out and a validation report demonstrating its effectiveness has been approved in writing by the Local Planning Authority. The reason for the condition is :- To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors.
13.REASON FOR APPROVAL OF THE APPLICATION :- The proposals meet the criteria for new housing development set out in saved Policy HOU7 of the Great Yarmouth Borough-Wide Local Plan.
14.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
15.NOTES - Please read the following notes carefully:- Occasionally European protected species, such as bats, can be found during the course of the development. In the event that this occurs, it is advised that the developer stops work immediately and seeks the advice of a suitably qualified ecological consultant.
16.NOTES - Please read the following notes carefully:- The site will potentially generate a significant amount of dust during the conversion process; therefore, the following measures should be employed: - - An adequate supply of water shall be available for suppressing dust; - Mechanical cutting equipment with integral dust suppression should be used; - There shall be no burning of any materials on site.
17.NOTES - Please read the following notes carefully:- The site is located within the Shoreline Management Plan erosion zones for both the 2025 and 2055 epochs. The developer / owner should be aware of the prospect of longer term coastal change and potential erosion.
