1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is:- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the application form, specification list and approved plans listed below: · Elevation of illuminated letters · Typical Illuminated Letter · Site Location Plan · Letter impression as received by the Local Planning Authority on the 23rd July 2021. The reason for the condition is:- For the avoidance of doubt.
3.The letters hereby approved shall not be illuminated outside of the hours below: 09:00 - 00:00 Hours Monday - Sunday The reason for the condition is :- The restriction is imposed to avoid artificial lights affecting the coastline outside of the hours of use of attractions within the Prime Commercial Holiday Area, and to ensure there is consistency with other attractions within the Prime Commercial Holiday Area.
4.The level of illuminance of the signs hereby permitted shall be restricted to the same maximum level as is proposed in the application - the LED lights serving the letters shall be no more than 110 Im/watt and the combined wattage shall be no more than 180w and emit no more than 19,800 lumens over the approved 26.8m2 surface area. The reason for the condition is: - In the interests of highway safety and residential and visual amenity.
5.The letters hereby approved shall be removed from the site by no later than 01st October in any year and shall not be erected again until 29th April in the following year at the earliest. The reason for the condition is :- To be consistent with the stated intentions of the application in order to enable the internally illuminated letters signs to provide a high quality tourist attraction during summer tourist seasons, in line with Core Policy CS8 (e), whilst preventing detriment to visual amenity and townscape setting and dark sky environments during winter months.
6.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
