| 1. | Time Limit - commencement
The development hereby permitted must be begun not later than the expiry of two years from the date of this permission.
The reason for the condition is: - The time limit condition is imposed in order to comply with Condition 2 of the parent outline planning permission 06/16/0583/O and the requirements of Section 92 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004 |

| 3. | Retention of hedgerows and Trees (required during construction)
All approved tree and hedgerow protection measures (detailed on Tree Survey, AIA & Protection Plan No. LSDP 2411.01 dated January 2025) shall be installed prior to the commencement of development work to implement this planning permission.
The approved protection measures shall be maintained in good condition and adhered to throughout the construction period. Unless otherwise agreed in writing by the Local Planning Authority, no construction-related activities (for example: storage and/or siting of: vehicles, fuel, materials, site huts or other buildings or ancillary equipment; raising of lowering of ground levels; installation of underground services, drains; lighting of fires etc.) may be undertaken within the identified Construction Exclusion Zones and fenced areas.
In the event that any tree(s)/hedgerows become damaged during construction, the Local Planning Authority shall be notified, and remedial action shall be proposed, agreed and implemented. In the event that any tree(s) dies or is removed without the prior approval of the Local Planning Authority, it shall be replaced within the first available planting season, in accordance with details to be agreed with the Local Planning Authority.
The reason for the condition is: - To ensure retention of the tree and hedgerow features that contribute to the character of the site and surroundings in accordance with Policy CS11 of the Core Strategy (2015) and Policy E4 of the Local Plan Part 2 (2021). |
| 4. | Ecological Mitigation (required during construction)
The ecological mitigation measures as set out in sections 6 and 7 Ecological Assessment (2025), dated 11 May 2025 prepared by Hopkins Ecology shall be carried out in full during the course of construction, in accordance with the submitted details.
The reason for the condition is: - To protect biodiversity on site in accordance with Core Strategy (2015) Policy CS11. |
| 5. | EV charge points (prior to first occupation of each dwelling)
Prior to first occupation of each dwelling, an electric vehicle charging point (min 7kW) shall be provided and made available for use in accordance with the details shown on Site Layout SL01 Rev L and shall be retained as such thereafter.
The reason for the condition is: - To ensure appropriate provision for the demand for electric vehicle charging within the lifetime of the development in accordance with Policy I1 of the Local Plan Part 2 (2021). |
| 6. | Ecological Enhancement (prior to first occupation of each dwelling)
The ecological enhancement measures as set out in paragraph 6.16 of the Ecological Assessment (2025), dated 11 May 2025 prepared by Hopkins Ecology shall be provided prior to the first occupation of each dwelling. The mitigation measures shall thereafter be retained in perpetuity in accordance with the submitted details.
The reason for the condition is: - To provide biodiversity enhancements on site in accordance with the aims of Core Strategy (2015) Policy CS11 and Hemsby Neighbourhood Plan Policy 13. |
| 7. | Safeguarded Cycle and Pedestrian Route
There shall be no development at, on or over the land, and no alternative use of the land referred to within the development as the potential strategic cycle link and pedestrian route as shown on drawing numbers: 2097-SL01 rev L Site Layout Plan, and LS2411-021 Hemsby Rev B - Landscape Proposal whatsoever other than the works which shall be provided pursuant to the approved landscape scheme hereby permitted and any development, use, operation or works required to deliver the approved scheme. The land shall thereafter be maintained as a landscaped area until such time as the cycle and pedestrian route is provided and maintained as such to facilitate the development's contribution to the 'green travel' route anticipated by adopted Local Plan Part 2 Policy GSP7 and Emerging Local Plan Policy SUT1.
The reason for the condition is: - To safeguard the land for beneficial use as a potential strategic cycling and pedestrian route and to ensure its meanwhile use as a landscape area, in accordance with Policy GSP7 of the Local Plan Part 2 (2021) and the aims of Emerging Local Plan Policy SUT1. |
| 8. | Approval of conditions applied for:
Condition 20 of outline permission ref 06/18/0583/O - Surface Water Drainage
Condition 20 requires details of a surface water drainage scheme incorporating the measures as specified in the condition to be submitted to and agreed by the Local Planning Authority in consultation with the Lead Local Flood Authority prior to commencement of development and the scheme as approved shall be implemented prior to the first occupation of the development and shall be maintained and managed as approved for the lifetime of the development.
In support of this application for condition discharge the applicant submitted:
- Drainage Strategy Summary Report no. 62039-RJL-XX-XX-RP-C-S3-0001 Issue P03 dated 06.10.25.
The submitted details are acceptable and are hereby approved however this condition can only be discharged in part as the development has to be undertaken in accordance with the approved details prior to the first occupation of the development and shall be maintained and managed as approved for the lifetime of the development.
Condition 24 of outline permission ref 06/18/0583/O - Landscaping
Condition 24 requires that no development shall take place until there has been submitted to and approved by the Local Planning Authority details of a scheme of landscaping, which include indications of all existing trees and hedgerows on the land, and details of any to be retained, together with measures for their protection in the course of development.
In support of this application for condition discharge the applicant submitted:

The submitted details are acceptable and are hereby approved however this can only be discharged in part as the development has to be undertaken in accordance with the approved details and in respect of the landscaping proposals LS2411-021 Rev B and 022 Rev B shall be carried out prior to the occupation of the dwelling to which the landscaping relates. |
| 9. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
It is confirmed that this shadow HRA submitted has been assessed as being suitable for the Borough Council as competent authority to use as the HRA record for the determination of the planning application, in accordance with the Conservation of Habitats and Species Regulations 2017.
In this instance the Borough Council has considered there is no likely significant effect on protected habitats arising solely from the development itself; and the development would contribute to the overall in-combination significant adverse effect identified by the Habitats Regulations Assessment Report for the Local Plan Core Strategy, but this effect can be adequately mitigated by the Habitats Monitoring and Mitigation Strategy; and that Strategy requires a payment of £304.17 per each additional dwelling towards the monitoring and mitigation provided through that Strategy. The total GIRAMS payment required is £28,287.81 (£304.17 x 93 dwellings).
Of this total, £10,230 has already been received by the Council when the current Reserved Matters application ref: 06/21/0495/D was first submitted in June 2021 (based upon the then figure of £110 per dwelling). A further payment of £18,057.81 is required to be paid before the current Reserved Matters application can be Approved. This will comprise of £6164.66 secured from Schedule 5 of the S106 Agreement dated 7 June 2018 which requires a payment of £50 per dwelling (index linked) and a further top up payment of £11,893.15.
The applicant has agreed to pay the outstanding balance of GIRAMS of £18,057.81 prior to the issuing of the Reserved Matters Approval under application 06/21/0495/D. This payment was received on 2 January 2026. |

1. The applicant's attention is drawn to the remainder of the conditions on outline planning permission no. 06/16/0583/O, and development must be carried out strictly in accordance with the conditions specified.
2. This permission is subject to a legal agreement under section 106 of the Town and Country Planning Act 1990 dated 7 June 2018.
3. The applicant's attention is drawn to the comments of Essex and Suffolk Water & Northumbrian Water Limited regarding their apparatus/assets within the vicinity of the site
and the need to review works to take place within the vicinity of these and the possibility of requirement for diversion of the mains.
