1.The development must be begun not later than three years beginning with the date of the original permission reference 06/20/0159/F approved on the 5th November 2020. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the following plans: - Block and Location Plan 001 - received by the Local Planning Authority on the 26th October 2020 as part of planning permission 06/20/0159/F. - Site Plan 002 Rev B - received by the Local Planning Authority on the 26th October 2020 as part of planning permission 06/20/0159/F. - Floor Plan 003 REV D - received on the 14th May 2021. - Floor/Roof Plan 004 REV D - received on the 14th May 2021. - Elevations 005 REV D - received on the 14th May 2021. - Elevations 006 REV E - received on the 23rd June 2021. The reason for the condition is:- For the avoidance of doubt.
3.The existing dwelling (as indicated on plan 007 received by the Local Planning Authority on the 26th October 2020 as part of application 06/20/0159/F) shall be demolished and all associated materials removed from site prior to the commencement of any works on the replacement dwelling. The reason for the condition is :- To enable the Local Planning Authority to retain control over the development in the interests of the visual amenities of the locality.
4.The development shall be carried out in accordance with the approved details for external materials as listed below the section headed 'External Materials' in the Planning Statement received by the Local Planning Authority on the 14th May 2021. For the avoidance of doubt these are: - RENDER (Used for Soffits as well) - Product: Weber Saint Gobain Weberpral MF - Finish: Smooth. Colour: Chalk - PORCELAIN CLADDING/CANOPY & FASCIA Product: Porcelanosa Ferroker 40x80 - WINDOWS/SLIDING DOORS - Windows & Doors: Powder Coated Aluminium Exterior Frame Colour: RAL 9005 - FACING BRICKWORK (BELOW DPC) - Product: Ibstock Atlas Silver Grey Frost Resistant Dark Grey, Black Mortar - RAINWATER GOODS - Product: Square/Rectangle Powder Coated Aluminium - Marley Alutech - COLUMN/BEAM ENCASEMENTS Product: Powder Coated Aluminium with RAL colour to Match External Window Frames - FLAT ROOF FINISH -Product: Sika Sarnafil Single Ply membrane with powder coated aluminium drip edge/parapet wall cappings No variation from the approved details shall take plan unless otherwise approved in writing by the Local Planning Authority. The reason for the condition is: - To ensure appropriate materials are used.
5.Prior to the first occupation of the development hereby permitted the proposed access and on-site car parking area shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan and retained thereafter available for that specific use. The reason for the condition is: - To ensure the permanent availability of the parking/manoeuvring areas, in the interests of satisfactory development and highway safety.
6.In the event that contamination that was not previously identified is found at any time when carrying out the approved development, it must be reported in writing immediately to the Local Planning Authority. All development shall cease and shall not recommence until: 1) a report has been submitted and agreed in writing by the Local Planning Authority which includes results of an investigation and risk assessment together with proposed remediation scheme to deal with the risk identified and 2) the agreed remediation scheme has been carried out and a validation report demonstrating its effectiveness has been approved in writing by the Local Planning Authority. The reason for the condition is :- To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors.
7.Construction work shall not take place outside the following hours:- 08:00 to 18:00 Mondays 08:00 to 18:00 Tuesdays 08:00 to 18:00 Wednesdays 08:00 to 18:00 Thursdays 08:00 to 18:00 Fridays 08:30 to 13:30 Saturdays and no work shall take place on Sundays or Bank Holidays. (These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property) The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings.
8.Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any amendment revoking or re-enacting that Order) the dwelling hereby permitted shall not be further extended in any way without first obtaining the express written permission of the Local Planning Authority. The reason for the condition is:- To enable the Local Planning Authority to retain control over any further extensions to the dwelling in the interests of residential amenity.
9.The bird boxes, as listed below heading 'Bird Boxes' in the Planning Statement received by the Local Planning Authority on the 14th May 2021, shall be installed prior to the first occupation of the dwelling. The bird boxes shall remain thereafter in perpetuity. For the avoidance of doubt the bird boxes shall be Johnston-Jeff Classic Nest Boxes. The reason for the condition is :- To secure biodiversity enhancements.
10.The windows labelled as obscure glazed on drawing 003 Rev D and 004 Rev D shall be fitted with obscure glass to a level equivalent to Pilkington Privacy Level 5 which shall be installed prior to the first occupation of the dwelling and this obscure glazing shall be retained in perpetuity. The reason for the condition is :- In the interests of neighbouring amenity.
11.REASON FOR APPROVAL OF THE APPLICATION :- The proposals meet the criteria for new housing development set out in saved Policy HOU7 of the Great Yarmouth Borough-Wide Local Plan.
12.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
13.NOTES - Please read the following notes carefully:- Occasionally European protected species, such as bats, can be found during the course of the development. In the event that this occurs, it is advised that the developer stops work immediately and seeks the advice of a suitably qualified ecological consultant.
14.NOTES - Please read the following notes carefully:- The developer should carry out an asbestos survey prior to demolition in order to identify asbestos containing materials (ACMs). The developer has a legal duty to remove most ACMs before demolition and some ACMs must be removed by contractors licensed by the Health and Safety Executive (HSE). If at any stage during demolition asbestos is suspected the work should be stopped and the material investigated.
