1.This permission expires on the 31st December 2022 and unless on or before this date specific application has been made for an extension to the period of permission and such application is approved in writing by the Local Planning Authority the use shall be discontinued no later than 31 December 2022. The reason for the condition is:- In order to retain control over the use of the site until the effects of the proposal have been experienced and in the interest of the amenities of the locality.
2.The development shall be carried out in accordance with the site location plan received by the Local Planning Authority on the 14th June 2021 and the activities and parking area shall be arranged in accordance with the site layout plan received by the Local Planning Authority on the 7th August 2021. The reason for the condition is:- For the avoidance of doubt.
3.For each and every car boot sale event, space sufficient to the satisfaction of the Local Planning Authority shall be provided within the site to enable a minimum of 270 cars to park, turn and re-enter the highway in forward gear. Each space provided shall be arranged, marked or marshalled into position, to allow a space of at least 2.5m width x 5m depth. This area shall be laid out, demarcated, marshalled and be retained for that specific use for the duration of the car boot sale event, and shall be removed thereafter. The reason for the condition is: - To ensure the permanent availability of the parking/manoeuvring areas, in the interests of satisfactory development and highway safety.
4.Notwithstanding the details shown on the submitted site layout plan and the proposed photographs of past events, there shall be no use of the site whatsoever for the purpose hereby permitted until such time as the public footpath has been identified, cordoned-off and protected for use by pedestrians at all times during site set-up, sales event, and decommissioning of the car boot sale. The footpath route shall be provided as follows: - it shall be afforded a minimum of 2.0m useable width, - it shall be provided with a continuous barrier to segregate pedestrians and users of the public right of way from vehicles using the access and roadway into the site, - it shall be routed from the junction with Main Road to the northern boundary of the site in a continuous fashion, and, - shall provide for at least one entrance / access point into the car boot sales area site, measuring no less than 1.5m and no more than 2.0m width. For the avoidance of doubt, use of detached cones alone is not considered sufficient nor appropriate; a temporary barrier must be provided. A site marshall shall also be available to ensure the footpath remains available whilst managing car park use. The footpath segregation shall be provided for each car boot sales event, notwithstanding the provisions within Part 4 Class BA of the Town and Country Planning (General Permitted Development)(England) Order 2015, as amended. The reason for the condition is: - To ensure permanent availability, unobstructed use and safety for users of the public right of way during the period of activity hereby permitted, and to encourage more sustainable forms of access for customers and patrons attending the events.
5.Notwithstanding the provisions within Part 4 of the Town and Country Planning (General Permitted Development)(England) Order 2015, as amended, no more than 28 car boot sales shall be held in any calendar year, on the land outlined in red on the location plan received by the Local Planning Authority on the 14th June 2021. During 2021 this shall be inclusive of any events held between 01 January 2021 and the date of this permission. In the calendar year from 01 January 2022 to 31 December 2022 inclusive 28 days shall be the maximum total number. The applicant shall maintain a log book detailing dates or each car boot sale event for the duration of this permission. The log book shall be maintained for or the duration of this permission and shall be made available for officers from the Local Planning Authority to view at all times. The reason for the condition is :- To ensure that the development is carried out in the manner contemplated by the Local Planning Authority in the interests of amenity and highways safety.
6.The use of the land shall not occur outside of the following hours:- 06:30 to 13:00 hours on no more than 28 Saturdays per calendar year. For the avoidance of doubt this period shall include the site set-up and removal of the event which shall not take place outside the defined period. The reason for the condition is:- To protect the amenities and character of the area.
7.There shall be no fee or charge to park a car on the car park identified on the site layout plan received by the Local Planning Authority on the 7th August 2021 whilst the car boot sale is in operation. The reason for the condition is :- To ensure that visitors are not dissuaded from utilising the on-site car parking, in the interests of maintaining the free flow of traffic and highways safety.
8.REASON FOR APPROVAL OF THE APPLICATION :- The proposal meets the aims of saved policy SHP13.
