1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- Required to be imposed pursuant to Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the plans and details listed below other than where amendments are required by other conditions of this permission: - Existing Location Plan: 345-01 - received by the Local Planning Authority on the 2nd July 2021. - Proposed Site Plan (with Typical Fence & Gate Details): 345-02-Rev E - received by the Local Planning Authority on the 17th June 2022. - Proposed Cross Sections (Trees at base of bund): 345-04, received by the Local Planning Authority on the 22nd July 2022. - Letter ref: HA2196/DC 'Proposed Drainage Strategy', dated 02/12/2021. The security fencing to be used shall be that of the mesh fence type shown in the photograph image within revised site layout plan 345-02-Revision E, and NOT the palisade panel style fence shown in the same plan. The mesh fence shall be painted or galvanised olive green. The reason for the condition is :- For the avoidance of doubt and to avoid an unacceptable landscape impact.
3.The site hereby approved shall only be used for the storage of of unmotorised caravans and shall not be used for storing campervans, mobile homes, trailers or other such containers or vehicles. There shall be no more than 40 caravans stored within the application site at any one time. The reason for the condition is :- To enable the Local Planning Authority to control the number of caravans on the site and in the interest of the visual amenities of the area and the protection of the watercourses and groundwater from motorised appliances or the effects of degradation of other vehicles in storage.
4.At no time whatsoever shall the caravans be occupied or used for any form of recreational, residential or business activity within the development site hereby permitted. The reason for the condition is :- In the interests of preventing a risk to life from flooding.
5.The development shall be constructed to include the 5no. permeable drainage pipes and the permeable strata of site construction shown on the approved site layout plan 345-02-Rev E and as described within the letter ref: HA2196/DC 'Proposed Drainage Strategy', dated 02/12/2021. The reason for the condition is :- To ensure appropriate surface water drainage and reduce the risk of flooding.
6.No caravan(s) shall be brought into the site until the existing earth bund has first been raised up to 2.0m in height (when measured from the finished ground level of the interior of the site) which shall be undertaken for the full length of the south and west boundaries, in accordance with the detail shown on approved plan 345-02 received on 22 July 2022. The earth bund shall thereafter be maintained at a height of no less than 2.0m (when measured from the adjoining ground level of the interior of the site) for the complete length on the south and west boundaries and shall be retained in the approved position thereafter for the duration of the use of the site for the purposes hereby permitted. The reason for the condition is :- To protect the visual amenities, outlook from, and setting of the adjacent Broads Authority Area.
7.Part (A) Notwithstanding the proposals shown for the north boundary on approved layout plan 345-02 revision E, there shall be no use of the development hereby permitted until a native hedge has first been planted along the full length of the site's northern boundary, in a double-staggered row with protection to the whips being installed. This shall be in addition to the planting of at least 12no. trees to be provided along the northern boundary, in accordance with the notation on the approved layout plan 345-02 revision E rather than the schematic drawing. The planting shall be undertaken in accordance with the details of a landscaping scheme comprising planting plan and schedule to be first submitted to and approved in writing by the Local Planning Authority prior to the first use of the site and shall be planted no later than the first growing season following the approval of those details. PART (B) The planting of trees and shrubs on the west and south boundary bunds shall be carried out in accordance with the scheme and specifications, including species proposed, as shown on approved plan 345-04. The planting shall be undertaken no later than the first growing season following the first use of the site. PART (C) Any trees and shrubs so planted within the development pursuant to parts A and B of this permission, which dies within 10 years of planting, shall be replaced within the next growing season by the applicants or their successors in title with similar species suitable to the situation and of the same stature. The reason for the condition is:- To enhance the visual amenities of the locality and protect the outlook from, and setting of, the adjacent Broads Authority area.
8.There shall be no use of the development hereby permitted until a detailed scheme for the design of the vehicular access and culvert crossing over the ditch/watercourse has first been submitted to and approved in writing by the Local Planing Authority. Arrangement shall be made for surface water drainage to be intercepted and disposed of separately so that it does not discharge from or onto the highway. The development shall thereafter be constructed in accordance with the approved details prior to the commencement of the use hereby permitted, which shall be retained at the position shown on the approved plan. The reason for the condition is: - To ensure construction of a satisfactory access and to avoid carriage of extraneous material or surface water from or onto the highway in the interests of highway safety.
9.Prior to the first use of the development hereby permitted the proposed access/on-site parking/servicing/loading/unloading/turning/waiting area shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan and retained thereafter available for that specific use. The reason for the condition is: - To ensure the permanent availability of the parking/manoeuvring areas, in the interests of satisfactory development and highway safety.
10.There shall be no use of the site hereby permitted until the development has created a Flood Risk Response Plan and the business has been signed up to the Environment Agency's Flood Warnings Direct service, and a Business Flood Plan has been created and brought into use, and a Flood Kit prepared and made available for use by employees and visitors to the site in the eventuality of flooding. The measures shall be undertaken in accordance with the recommendation set out within Chapters 6.2 - 6.4 inclusive of the submitted Flood Risk Assessment: report ref: 2748/RE/06-21/01 dated June 2021. The reason for the condition is :- To protect the future users of the site from the consequences of flooding and to reduce flood risk in the development.
11.Any access gates/bollard/chain/other means of obstruction shall be hung to open inwards, set back, and thereafter retained a minimum distance of 16 metres from the near channel edge of the adjacent carriageway. The reason for the condition is: - In the interests of highway safety enabling vehicles to safely draw off the highway before the gates/obstruction is opened.
12.REASON FOR APPROVAL OF THE APPLICATION :- The proposal meets the criteria set out in Core Policies CS06, CS09, CS11, CS12, CS13 and CS16, and policies GSP5, E1, E4 and E6 of the Local Plan Part 2.
13.STATEMENT OF ENGAGEMENT: Whilst it is acknowledged to have taken longer than desirable, in dealing with this application Great Yarmouth Borough Council has worked with the applicant to eventually secure a suitably revised scheme to enable a favourable determination and grant of permission.
