1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- Required to be imposed pursuant to Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the site location plan and the following approved plans and details: - Proposed Ground Floor plan 7689 - 19 Revision V; - Proposed First Floor plan 7689 - 20 Revision Q; and, - Proposed Elevations 7689 - 22 Revision C, as received by the Local Planning Authority on 15th October, 2021. The external materials to be used in the development shall be in accordance with those as specified on drawing number 22 Revision C. The reason for the condition is :- For the avoidance of doubt.
3.Notwithstanding the requirements of Condition 4 of this permission, there shall be no commencement of the development hereby permitted until a scheme for the provision and implementation of flood proofing techniques within the development has first been submitted to and approved in writing by the Local Planning Authority in consultation with the Environment Agency. The proposals shall be drawn up with regard to the ODPM guidance "Preparing for floods". The development shall thereafter be constructed in strict accordance with the approved details, which shall be installed and made operational prior to the first use of the development, and shall be retained as such thereafter. The reason for the condition is :- To minimise the damage to property in the event of flooding, in accordance with the recommendation of the flood risk assessment.
4.The development hereby permitted shall be carried out incorporating the measures to mitigate the risk from flooding set out in the applicant's Flood Risk Assessment received by the Local Planning Authority on 8th July, 2021 (Report Ref: 2737/RE/06-21/01). In particular the development shall be constructed to include the Water Entry Strategy set out at section 6.3 (page 11) of the approved Flood Risk Assessment, and the associated features of construction shall be completed, fully installed and made operational in strict accordance with the Water Entry Strategy details before any part of the development if brought into use. The development hereby permitted shall also be constructed and completed in accordance with Communities and Local Government document "Improving the Performance of New Buildings - Flood Resilient Construction" available for download for free at http;//www.planningportal.gov.uk/uploads/br/flood performance.pdf The reason for the condition is :- To ensure that mitigation measures are undertaken as the property is located within an area at risk of flooding.
5.There shall be no use nor occupation of the development hereby permitted until a detailed Flood Response Plan has first been submitted to and approved in writing by the Local Planning Authority. The details of the Flood Response Plan shall include but not be limited to the proposals set out within the applicant's Flood Risk Assessment received by the Local Planning Authority on 8th July, 2021 (Report Ref: 2737/RE/06-21/01) (as set out at sections 6.4 and 6.6 therein), as well as the advice of the Great Yarmouth Borough Council Emergency Planner and the Emergency Services. The Flood Response Plan shall include ensuring the site is brought into the Environment Agency's Flood Warning Service, and shall include evacuation procedures, and the approved Flood Response Plan shall be brought into use upon first occupation of the development, and shall be be made available to all future occupiers of the site and management and staff thereof. The development shall continue to be operated thereafter in accordance with the Flood Response Plan. The reason for the condition is :- In accordance with the recommendations of the flood risk assessment, to minimise the risk to the occupants in the event of flooding.
6.The existing trees adjoining the site at its eastern boundary shall not be lopped or damaged in any way without the prior consent in writing of the Local Planning Authority. The reason for the condition is:- The existing trees represent an important visual amenity which the Local Planning Authority consider should be substantially maintained.
7.There shall be no digging within the spread of tree roots to trees within the highway for a distance of 5m as measured from the eastern boundary of the site without prior agreement of the local planning authority in consultation with the borough tree officer. There shall be no materials storage within the same specified area. Details of the root protection area and measures to protect the trees along the eastern boundary of the site, shall be submitted to and agreed in writing prior to the commencement of the proposed adjoining residential development. The reason for the condition is :- The existing trees represent an important visual amenity which the Local Planning Authority consider should be substantially maintained.
8.No development shall take place until there has first been submitted to and approved in writing by the Local Planning Authority a scheme of proposed landscaping to be provided within the site, which shall include the following information: - indications of all existing trees and hedgerows on and adjoining the land, and details of any to be retained, - details of measures for existing trees and hedge protection for use during the course of development, - proposed hard landscaping, - proposed soft landscaping, to include tree planting and suitable boundary treatment hedging (including species and specifications), - details of all protection measures for the soft landscaping during their establishment; and, - maintenance and management details and schedules for maintaining landscaping once provided. There shall be no occupation or use of the development hereby permitted until the landscaping has been provided and the planting maintenance commenced, which shall be retained and maintained as such thereafter. The reason for the condition is:- In the interests of the visual amenities of the locality and the amenities of residents within the development.
9.Prior to the first use of the development hereby permitted the proposed on-site car and cycle parking shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan and retained thereafter available for that specific use. The reason for the condition is: - To ensure the permanent availability of the parking/manoeuvring areas, in the interests of satisfactory development and highway safety.
10.The development hereby permitted shall not commence until an investigation and risk assessment has been completed in accordance with a scheme to be first agreed in writing by the Local Planning Authority, to assess the nature and extent of any contamination on the site, whether or not it originates on the site. The written report(s) shall include: (i) a survey of the extent, scale and nature of contamination; (ii) an assessment of the potential risks to: · human health, · property (existing or proposed) including buildings, crops, livestock, pets, woodland and service lines and pipes, · adjoining land, · groundwaters and surface waters, · ecological systems, (iii) an appraisal of remedial options if required, (iv) A detailed remediation scheme to bring the site to a condition suitable for the intended use by removing unacceptable risks to human health, buildings and other property and the natural and historical environment. The scheme must include all works to be undertaken, proposed remediation objectives and remediation criteria, timetable of works and site management procedures. The scheme must ensure that the site will not qualify as contaminated land under Part 2A of the Environmental Protection Act 1990 in relation to the intended use of the land after remediation. The reason for the condition is :- To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors. Note This must be conducted in accordance with the Environment Agency's 'Land contamination risk management (LCRM)'.
11.The development hereby permitted shall not commence (unless otherwise agreed in writing by the Local Planning Authority) until: 1) the approved contamination remediation scheme required by Condition 10 has first been carried out in full, and, 2) a validation report that demonstrates the effectiveness of the remediation carried out has first been submitted to and approved in writing by the Local Planning Authority. Reason for the condition is :- To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors.
12.In the event that contamination that was not previously identified is found at any time when carrying out the approved development, it must be reported in writing immediately to the Local Planning Authority. All development shall cease and shall not recommence until: 1) a report has been submitted and agreed in writing by the Local Planning Authority which includes results of an investigation and risk assessment together with proposed remediation scheme to deal with the risk identified and 2) the agreed remediation scheme has been carried out and a validation report demonstrating its effectiveness has been approved in writing by the Local Planning Authority. The reason for the condition is :- To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors.
13.Construction work shall not take place outside the following hours:- 08:00 to 18:00 Mondays to Fridays 08:30 to 13:30 Saturdays and no work shall take place on Sundays or Bank Holidays. (These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property) The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings.
14.REASON FOR APPROVAL OF THE APPLICATION :- The proposal enhances the provision of specialist housing with care, in accordance with policies CS1 and CS13 of the Great Yarmouth Borough Core Strategy and Policy C1 of the adopted Local Plan Part 2.
15.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
16.NOTES - Please read the following notes carefully:- The site will potentially generate a significant amount of dust during the conversion process; therefore, the following measures should be employed: - - An adequate supply of water shall be available for suppressing dust; - Mechanical cutting equipment with integral dust suppression should be used; - There shall be no burning of any materials on site.
