1.Core Policy CS15 recognises that community uses - such as public houses - are particularly vulnerable to development and therefore a thorough marketing exercise and viability assessment is required to demonstrate that the public house use is no longer viable. No evidence has been provided to demonstrate that this has taken place. The application is therefore contrary to Core Policy CS15 from the adopted Core Strategy which seeks to protect community uses as an essential part of maintaining sustainable communities.
2.The application site is located within the 400m to 2.5km Orange Indicative Habitat Impact Zone and therefore any increase in dwelling units requires a Habitat Regulations Assessment (HRA) and financial contribution to the Habitat Monitoring and Mitigation Scheme (HMMS). There has not been a HRA provided or HMMS fee received as part of this application. As such the Local Planning Authority cannot fully assess the additional impact upon the Natura2000 sites within the Borough, nor can it is it able to secure the appropriate mitigation. Consequently, the application is contrary with Core Policy CS11 from the adopted Core Strategy.
3.The proposed shower rooms indicated on the proposed plans are cramped and of an inadequate size. This would be detrimental to the amenity of future residents. The proposal is therefore contrary to CS09 F from the adopted Core Strategy which seeks to ensure sufficient levels of amenity for residents.
4.STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
