| 1. | The application site is located outside the village development limits and seeks the erection of two dwellings; consequently, the application is contrary to saved policy HOU07 from the Borough-Wide Local Plan and Core Policy CS02 (a) from the adopted Core Strategy. Justification has not been given that the proposal should be assessed against saved policy HOU10 from the Borough-Wide Local Plan and furthermore it does not meet the criteria required. The site has a lack of safe pedestrian access to local amenities and therefore it is considered that there would be a reliance on the private car for future occupants of the proposed development. As such it would be contrary to core policy CS01 (e) from the adopted Core Strategy, which seeks to ensure that new developments provide easy access for everyone to jobs, shops and community facilities by walking, cycling and public transport. Furthermore, it is considered that the application would not comply with core policy CS02 from the adopted Core Strategy which seeks to balance the delivery of new homes with the creation of self-contained communities and reducing the need to travel. |
| 2. | The site is located within the Red Indicative Habitats Impact Zone and a bespoke HRA has not been submitted. It has therefore cannot been assessed as part of this application whether there are any in combination or direct effects on the designated site that is within 400m of the application site. The failure to assess the impact of a development fails to ascertain whether the impact can be mitigated. In the absence of the bespoke HRA the application cannot be approved without failing in its duty with regards to The Conservation of Habitats and Species Regulations 2017. The application fails to comply with the regulations in related to Natura 2000 sites and is therefore contrary to Core Policy CS11 from the adopted Core Strategy. |
| 3. | There is no drainage strategy submitted in support of the application and this is required in order to make a complete assessment of the potential impact on the designated area by way of surface and foul water drainage. It is not demonstrated that there will not be an adverse impact by way of contamination through hydrological links to the designated area. This is contrary to Core Policy CS11 D/G from the adopted Core Strategy. |
| 4. | The proposal by virtue of its cul-de-sac form would have an urbanising impact on an area which is predominantly open countryside. This would be out of keeping with the character of the area which sees dwellings with road frontage or courtyard development. This is contrary to Core Policy CS09 A/C/G from the adopted Core Strategy. |
| 5. | STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above. |
