1.By no later than 01 September 2022, all the security fencing erected in 2021 shall be removed from the site perimeter and the close board timber fencing along the southern boundary adjacent the neighbouring terraced housing at Marine Terrace, shall be removed. The only exceptions to this shall be where the posts of the security fence are able to be reused as part of a replacement fence. The reason for the condition is :- The fence as erected is not appropriate in the Conservation Area and is detrimental to the amenity of neighbouring dwellings.
2.By 1st May 2022 and by 1st March of each year thereafter, a schedule of the rides to be used in the site and a proposed site structures layout plan shall be provided to the Local Planning Authority for its written approval, and the site shall be operated thereafter in accordance with those details. The reason for the condition is :- For the avoidance of doubt and to enable the Local Planning Authority to retain control over the use of the site and in the interest of the amenities of the occupants of adjoining dwellings.
3.By 1st May 2022 a Flood Warning and Evacuation Plan shall be submitted to and approved in writing by the Local Planning Authority, and the development shall be operated in accordance with those details thereafter. The reason for the condition is :- To minimise the risk to the occupants in the event of flooding and to assist the emergency services and local authority during a flood event.
4.By 1st May 2022 the full details of the proposed Portacabin Base Anchor System shall be submitted to and approved in writing by the Local Planning Authority, and the anchor shall be used in accordance with those details and shall be retained for the duration of the stationing of the portacabin within the site. The reason for the condition is :- To ensure the portacabin remains in-situ should there be a flood event. To prevent damage to property and the wider environment.
5.(a) By 1st May 2022 the full details of a landscaping scheme to provide screening and landscaping between the application site field and the adjoining terraced houses at Marine Terrace to the south shall be submitted to and approved in writing by the Local Planning Authority. The details shall include evidence of attempts that were made to liaise with those properties / landowners to find common ground on the proposed landscaping. (b) The approved landscaping scheme and boundary screening shall thereafter be provided, planted and maintained within 1 month of approval of those details (and in the event of the details not being approved a subsequent application shall be made within 1 month of the LPA's decision sufficient to address the concerns). The reason for the condition is :- In the interest of the amenities of the occupants of adjoining dwellings.
6.The permission hereby granted for the use of the site for operation of children's rides shall expire on 1st September 2023 and unless on or before this date application has been made for an extension to the period of permission and such application is approved by the Local Planning Authority the use shall be discontinued. The reason for the condition is:- In order to retain control over the use of the site until the effects of the proposal have been experienced and in the interest of the amenities of the locality.
7.The permission hereby granted for the use of the site for stationing of a portacabin, refreshment cabin and cash/token cabin shall expire on 1st September 2023 and unless on or before this date application has been made for an extension to the period of permission and such application is approved by the Local Planning Authority, these structures shall be removed from the site. The reason for the condition is:- In order to retain control over the appearance and situation of a building which is constructed of short-lived materials and in the interests of the visual amenities of the locality and the protection of the conservation area.
8.No rides or structures shall be used on the site other than those specifically included in the schedule to be agreed under Condition 2 of this permission. The reason for the condition is :- For the avoidance of doubt and to enable the Local Planning Authority to retain control over the use of the site and in the interest of the amenities of the occupants of adjoining dwellings.
9.No rides or structures shall be sited within 10m north of the boundary walls or fences of Marine Terrace. The reason for the condition is :- For the avoidance of doubt and to enable the Local Planning Authority to retain control over the use of the site and in the interest of the amenities of the occupants of adjoining dwellings.
10.Use of the site for children's rides shall not be open to customers outside of 10am-8pm on any day. The reason for the condition is :- To ensure the use does not prejudice the residential amenities of the occupiers of nearby dwellings
11.There shall be no use of loudspeakers and / or public address systems within the site (except for safety announcements). The reason for the condition is :- To ensure the use does not prejudice the residential amenities of the occupiers of nearby dwellings
12.There shall be no use of external amplified music. The reason for the condition is :- To ensure the use does not prejudice the residential amenities of the occupiers of nearby dwellings
13.There shall be no installation of any external lighting whatsoever without the details first being submitted to and approved in writing by the Local Planning Authority. The reason for the condition is :- To ensure the use does not prejudice the residential amenities of the occupiers of nearby dwellings
14.Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any amendment revoking or re-enacting that Order) there shall be no gates, walls, fences or other means of enclosure erected without first obtaining the express written permission of the Local Planning Authority. The reason for the condition is:- To enable the Local Planning Authority to retain control over the erection of any gates, walls, fences or other means of enclosure in the interests of residential amenity and the character and appearance of the Conservation Area.
15.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
16.NOTES - Please read the following notes carefully:- Regarding the Flood Evacuation Plan: This plan should identify the site's location, the risk of flooding and access and egress arrangements. It should identify what warning measures will be put in place and how occupants will be made aware of the risks. The plan should include detailed instructions to occupants about what to do in the event if a flood. Information regarding the availability of the Environment Agency's 'Floodline' flood warning scheme, shall be included. The plan to include that flood warning notices should be erected in numbers, and in prominent positions within the site. The notices should be kept legible and clear of obstruction to ensure that owners and users of the premises are aware that the land is at risk of flooding. The plan should be made available to future users of the site. The applicant is advised that planning permission is required for any new fence to be erected around or within the application site. Regarding any application for the erection of a boundary fence we refer you to the advice provided previously by the Highways Authority, that any future fence from the corner of Fiske's Opening to the first gate post should be set back on splay in order to retain visibility from the junction, with the post on the fence return at the junction being set back a minimum of 2.0m from the kerb/give way line and then splayed to the first gate post on Pavilion Road in order to provide a 2.0m x 38m (approx.) from the junction.
