1.A single dwelling to the rear of the line of terraces would appear incongruous given the surrounding built pattern of development. As such the application is contrary to Core Policy CS09 A and Adopted Policy A2 A/C which seek to ensure that new development respects the surrounding built context.
2.By virtue of the limited size of the plot, the introduction of a three-bedroom dwelling would result in the overdevelopment of the plot, giving a cramped form of development. The result of this is a lack of outdoor amenity space provided for future residents which would fail to accommodate certain day-to-day outdoor activities which are associated with a dwelling of this size. The application is therefore contrary to Core Policy CS09 A and Adopted Policy A2 A/C which seeks to prevent the over-development of sites, and Adopted Policy A1 and Core Policy CS09 F which seek to protect residential amenity for future and current occupants.
3.Given the first floor east facing window and the limited back to back distance to the donor dwelling, the potential for overlooking would likely be significant and therefore harmful to the amenity of residents of the donor dwelling. This would be contrary to Adopted Policy A1 A which seeks to prevent harmful overlooking and with Core Policy CS09 F which seeks to protect residential amenity for future and current occupants.
4.The financial contribution or other means of addressing the public open space demands of the development as required under Adopted Policy H4 has not been provided and it has not been demonstrated that it is otherwise unviable to do so or that there is a surplus of open space within the ward rendering the requirement unnecessary. As such, the impacts of the development and the pressures the development places on public open spaces have not been mitigated and the proposal is contrary to Adopted Policy H4.
5.The site is located within Flood Zone 3 and therefore at high risk of flooding. No sequential test - as required by Core Policy CS13 and Adopted Policy E1 - has been submitted as part of the application to identify and discount alternative sites for the development. As such, the proposal is contrary to Core Policy CS13 and Adopted Policy E1 and contrary to the approach of NPPF Paragraph 162.
6.STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
