1.The development must be completed within a period of 3 years starting with the date prior approval is granted. The developer must notify the local planning authority of the completion of the development as soon as reasonably practicable after completion. The reason for the condition is :- To comply with the provisions of Class Q
2.The development shall be carried out in accordance with the following plans and specifications: - Location plan NPS-DR-A-(00)-001 P1, - Visibility Splay Improvement Plan NCC-1347, and - Elevation Plan 01-01-19-2-1283-07, and - Elevation Plan 01-01-19-2-1283-08, received by the Local Planning Authority on the 24th February 2021; and. - Revised site plan NPS-00-00-DR-(**)-002 P2, and - Revised floor plan 01-02-19-2-1283-06-C, received by the Local Planning Authority on the 9th July 2021. The reason for the condition is:- For the avoidance of doubt.
3.There shall be no occupation of the development hereby approved, until the visbility splays have first been provided in full accordance with the details indicated in the approved plan drg no. NCC-1347. The splays shall therafter be maintained at all times free from any obstruction exceeding 0.225 metres above the level of the adjacent highway carriageway. The reason for the condition is:- In the interests of highway safety in accordance with the principles of the NPPF.
4.There shall be no occupation of any of the dwellings hereby approved, until no fewer than 3no swift terrace boxes and 2no bat boxes have been installed. The bird and bat boxes shall remain thereafter in perpetuity. The reason for the condition:- To provide biodiversity gains on site.
5.There shall be no occupation of dwellings 1 or 2 until the demolition of the cart shed has taken place and all associated materials have been removed from site. The reason for the condition is :- In the interests of providing adequate levels of light and ventilation for the occupants of dwellings 1 and 2.
6.The proposed development shall proceed in accordance with the mitigation measures outlined in section 7 of the Ecology Report (Wild Frontier Ecology; July 2021) received by the Local Planning Authority on the 9th July 2021. The reason for the condition is:- To mitigate any adverse impacts on biodiversity.
7.Construction work shall not take place outside the following hours:- 08:00 to 18:00 Mondays 08:00 to 18:00 Tuesdays 08:00 to 18:00 Wednesdays 08:00 to 18:00 Thursdays 08:00 to 18:00 Fridays 08:30 to 13:30 Saturdays and no work shall take place on Sundays or Bank Holidays. (These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property) The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings.
8.In the event that contamination which has not already been identified to the Local Planning Authority (LPA) is found or suspected on the site it must be reported in writing immediately to the Local Planning Authority. Unless agreed in writing by the LPA no further development (including any construction, demolition, site clearance, removal of any underground tanks and relic structures) shall take place until this condition has been complied with in its entirety. In the event that contamination which has not already been identified to the Local Planning Authority (LPA) is found or suspected on the site an investigation and risk assessment must be completed in accordance with a scheme which is subject to the approval in writing of the LPA. The investigation and risk assessment must be undertaken by competent persons and conform with prevailing guidance (including BS8485:2015+A1:2019, BS10175:2011+A2:2017 and CLR11) and a written report of the findings must be produced. The written report is subject to the approval of the LPA. In the event where remediation is necessary a detailed remediation method statement (RMS) must be prepared, and is subject to the approval in writing of the LPA. The RMS must include detailed methodologies for all works to be undertaken, site management procedures, proposed remediation objectives and remediation criteria. The approved RMS must be carried out in its entirety and the LPA must be given two weeks written notification prior to the commencement of the remedial works. Following completion of the approved remediation scheme a validation report that demonstrates the effectiveness of the remediation must be submitted and approved in writing by the LPA. The reason for the condition is:- To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors.
9.NOTES - Please read the following notes carefully:- The applicant is reminded that, under the Wildlife and Countryside Act 1981, as amended (section 1), it is an offence to remove, damage or destroy the nest of any wild bird while the nest is in use or being built. Planning consent for a development does not provide a defense against prosecution under this act. While trees and scrub are likely to contain nesting birds between 1st March and 31st August inclusive buildings can also support nesting birds. If works occur during the nesting period a careful check of the building by a competent ecologist should be undertaken to assess the nesting bird activity on the site during this period and has shown it is absolutely certain that nesting birds are not present.
10.NOTES - Please read the following notes carefully:- Occasionally European protected species, such as bats, can be found during the course of the development. In the event that this occurs, it is advised that the developer stops work immediately and seeks the advice of a suitably qualified ecological consultant.
11.NOTES - Please read the following notes carefully:- The site will potentially generate a significant amount of dust during the conversion process; therefore, the following measures should be employed: - - An adequate supply of water shall be available for suppressing dust; - Mechanical cutting equipment with integral dust suppression should be used; - There shall be no burning of any materials on site.
