| 1. | No 9 is located in Conservation Area No5 St Nicholas and Northgate and is in the view shed of the Town Wall a scheduled monument and Great Yarmouth Minster a Listed Building. The roof is visible from public viewpoints. Policy BNV09 " Demolition and tree works in conservation areas" states that within Conservation Areas proposals for the demolition of structures will only be permitted where the replacement preserves or enhances the character and appearance of the area. BNV18 " Alterations and extensions" requires alterations to be sympathetic to the character of the building and its setting. Core Strategy Policy CS10 "Safeguarding local heritage assets" promotes conservation and enhancement of the historic environment. Paragraph 196 of the NPPF requires the Local Planning Authority to consider the degree of harm weighed against the public benefits of the proposal and the use of the house. In this case it is considered that the use of the house is not prevented by the presence of the chimney and that the demolition of the chimney will not preserve and enhance the character and appearance of the conservation area, that demolition would have an adverse impact within the wider setting of a number of listed buildings and a Scheduled monument. Chimneys are considered to be an important feature of the conservation area, in this case demolition will interrupt the existing visual rhythm and symmetry of the roof-scape along the terrace and would dilute the character of the building and terrace by removing this feature, contrary to the above policies. |
| 2. | STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above. |
