1.See letter generated for decision text as follows: The Borough Council have considered your application and have decided to grant the following consent: ยท CONSENT DETAILS This consent is subject to these conditions: (1) The work must be carried out within two years of the date of this consent notice and may only be carried out once. Reason: The time limit condition is imposed in order to comply with the requirements of the Town and Country Planning Act 1990 as amended by the Town and Country Planning (Tree Preservation) (England) Regulations 2012. (2) The work is to be carried out in accordance with British Standard 3998:2010 (Recommendations for Tree Work). Reason: To ensure an acceptable standard of work, thereby minimising possible damage and decay/disease in the future. (3) Tree Replacement : A replacement tree should be planted in the first autumn/winter period (beginning of October to end March) following the felling of the tree. The replacement tree should be an oak. The tree should be planted as a 10-12cm girth container grown specimen. All works should be carried out to British Standard 8545 Trees: from nursery to independence in the landscape. Replacement planting should in proximity to the original tree. Should the replacement tree be removed, die, or become severely damaged or diseased within 5 years of planting it shall be replaced with another of the same size and species of that originally planted. Once the replacement tree has been planted, written notification of this will be required. Replanting shall be carried out in accordance with the attached schedule, in a location near the present site of the oak tree but moved to allow construction of the approved extension (reference: 06/18/0054/F) so that the future life of the new tree will not be affected by the extension. Tree work should be carried out by trained, competent and appropriately insured arborists, to a good standard to comply with BS 3998 Recommendations for Tree Work. Photos of the tree after the consented works have taken place are required. Please forward these via email or post. Protected Species: The applicant should note that under the terms of the Wildlife and Countryside Act 1981, it is an offence to disturb nesting birds, bats their roosts and other protected species. You should note that work hereby granted consent does not override the statutory protection afforded to these species and you are advised to seek expert advice if you suspect that nesting birds, bats and other species will be disturbed. Property Rights: The applicant should note that this consent does not affect any private property rights and therefore does not authorise the carrying out of any work on land or entering land outside his/her control.
