No.Condition Text
1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the application form received by the Local Planning Authority on the 25 February 2021 and plans (drawing reference: 17-082 102D and 17-082 103D) received by the Local Planning Authority on 25 February 2021. The reason for the condition is :- For the avoidance of doubt.
3.Notwithstanding the approved plans, prior to the commencement of the development hereby approved full details of the proposed windows shall be submitted to and approved by the Local Planning Authority. The details shall include the materials, finish and a profile plan at a scale of 1:20. The development shall be carried out in accordance with the approved details prior to first occupation of the dwelling. The reason for the condition is :- In the interests of visual amenity and in the interests of being visually sympathetic to the conservation area and adjacent listed building.
4.Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any Order revoking and re-enacting that order) the dwelling shall not be further extended in any way without the prior consent of the Local Planning Authority. The reason for the condition is:- To enable the Local Planning Authority to retain control over any further extensions to the dwelling in the interests of residential amenity.
5.No part of the proposed structure (to include fascia board / rainwater goods and guttering) shall overhang or encroach upon highway land and no gate, door, ground floor window if installed shall open outwards over the highway. The reason for the condition is :- In the interests of highway safety.
6.No work shall commence until the exact types and colours of the materials used in all external surfaces have been submitted to and approved by the Local Planning Authority. The development shall be carried out using the agreed materials. The reason for the condition is :- In the interests of the visual amenities of the area as precise details of the materials have not been submitted.
7.No gate/door/ground floor window shall open outwards over the highway. The reason for the condition is: - In the interests of highway safety.
8.NOTES - Please read the following notes carefully:- The development is also subject to a listed building consent 06/21/0062/LB) Be aware that the applicant should establish the boundary with the public highway. No interference with the highway will be allowed. Please consult: Highway.boundaries@norfolk.gov.uk for further details. REASON FOR APPROVAL OF THE APPLICATION :- The proposal meets the criteria outlined in saved policy CS9 and CS10 of the adopted Core Strategy.
9.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner. It is confirmed that this shadow HRA submitted by the applicant has been assessed as being suitable for the Borough Council as competent authority to use as the HRA record for the determination of the planning application, in accordance with the Conservation of Habitats and Species Regulations 2017. In this instance the Borough Council has considered there is no likely significant effect on protected habitats arising solely from the development itself; and the development would contribute to the overall in-combination significant adverse effect identified by the Habitats Regulations Assessment Report for the Local Plan Core Strategy, but this effect can be adequately mitigated by the Habitats Monitoring and Mitigation Strategy; and that Strategy requires a payment of £110 per each additional dwelling towards the monitoring and mitigation provided through that Strategy.
