| 1. | The development must be begun not later than three years beginning with the date of this permission.
The reason for the condition is :-
The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
| 2. | The development shall be carried out in accordance with:
- Location Plan ref: 2020132 - 02, received by the Local Planning Authority on 16 December 2020; and,
- Revised Proposed Plans and Elevations, plan ref: 2020132 - 01 Rev D, received by the Local Planning Authority on 09 August 2021.
The reason for the condition is :-
For the avoidance of doubt and in the interests of visual amenity. |
| 3. | The development hereby permitted shall be finished in external materials using a reclaimed Norfolk red pantile, to match as closely as possible the appearance of the roofing tiles of 51 Staithe Road to the east, and in particular the garage thereof; and shall use a smooth coat sand and cement render with white masonry paint covering to match that on the existing Yew Tree Barn.
The reason for the condition is :-
In the interests of the visual amenity of the area and the preservation of the character and setting of the non-designated heritage asset. |
| 4. | There shall be no construction (including excavation) of the development hereby permitted until the Root Protection Area has first been defined, and confirmed in writing by a qualified arborist, and a construction exclusion zone has been installed around the tree using appropriate tree protection fencing around the root protection area. All tree protection fencing shall be installed in accordance with the recommendations of BS5837:2012.
During construction works the following measures shall be implemented and retained during the full period of construction:
- No materials shall be stored against this fencing or in the area within the root protection zone.
- No vehicles shall park within the fenced area.
- No refuelling shall take place within the site.
- No fires shall be lit within the site.
- Cementitious materials will not be stored within the fenced area.
- The ground level within the fenced area will not be reduced or disturbed other than for the works hereby permitted.
- The foundations for the development hereby permitted shall be hand dug unless any mechanical digging and excavation is overseen by on-site surpervision of a qualified arborist, and shall be undertaken in accordance with the recommendations of BS5837:2012.
The reason for the condition is :-
To ensure an acceptable standard of work in the vicinity of the tree, thereby minimising possible damage and decay/disease in the future. |
| 5. | All excavations and any works within the Root Protection Area shall be carried out in accordance with British Standard 5837:2012 (Trees in relation to Design, Demolition and Construction).
The reason for the condition is: -
To ensure an acceptable standard of work in the vicinity of the tree, thereby minimising possible damage and decay/disease in the future. |
| 6. | The garage / cartshed hereby approved shall only be used for private domestic use in connection with adjoining dwelling.
The reason for this condition is:-
In the interests of the residential amenities of the occupiers of adjacent property. |
| 7. | Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any amendment revoking or re-enacting that Order) the cartshed hereby permitted shall not be further extended in any way, nor shall doors be added to the open sides west or south elevations (as seen on approved plan 2020132 - 01 Rev D) without first obtaining the express written permission of the Local Planning Authority.
The reason for the condition is:-
To enable the Local Planning Authority to retain control over any further extensions to the cartshed/garage in the interests of protecting adjoining residential amenity, protecting the adjoining tree, and protecting visual amenity in order to protect the historic value of the adjoining non-designated heritage asset. |
| 8. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner. |
