1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is:- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the application form and the revised plans and elevations received by the Local Planning Authority on 12 July 2021, ref: 1553/12 Revision A(June 21)1. The reason for the condition is :- For the avoidance of doubt.
3.There shall be no use of the area shown for Gaming Machines within plan 1553/12 Rev A(June 21)1 for adult game machines until the proposed shopfront alterations to the west shopfront bay stallriser and window have first been completed in red brick blend materials to match the appearance and design of the eastern shopfront bay opposite. The alterations shall thereafter be retained. The reason for the condition is :- To secure the enhancements to the appearance of the shopfront and character of the conservation area in accordance with the Council's duty to preserve and enhance the conservation area heritage asset.
4.There shall be no commencement of the use as a gaming centre until the cafe area and staff reception have first been provided and brought into use across the whole frontage of the premises and measuring no less than 2.71m in depth when measured from the rear face of the entrance doors, as shown on the Proposed Ground Floor Plan within revised drawing 1553/12 Rev A(June 21)/1. The cafe and staff area shall be retained in such use thereafter for the duration of the adult gaming centre use hereby permitted. Any window displays shall be transparent, to reveal the interior, and shall be maintained and amended / updated on a regular basis and such display areas shall be retained thereafter for the duration of the use hereby permitted. The reason for the condition is :- To ensure the active character of the shopfront is retained in the interests of maintaining activity, vibrancy, vitality and viability of the town centre, as set out in core strategy policy CS7.
5.Notwithstanding the provisions of Part 3 of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended) (or any Order revoking or re-enacting that Order) the ground floor to the premises shall be used as an Adult Gaming Centre only, as designated with reference to The Gambling Act 2005 and (Licensed Premises Gaming Machine Permits) (England and Wales) Regulations 2007, and open to persons over the age of 18 therefore. The reason for the condition is:- For the avoidance of doubt and to retain control where the concept of material change offers too little certainty of control, and to ensure the use provides a service for the community, which formed part of the justification for the loss of previous cafe use from the defined town centre.
6.The premises shall not be open for business outside of the following hours:- 09.00 to 21.00 on any day of the year including Sundays and Bank / Public Holidays. The reason for the condition is :- In the interests of the amenities of the occupiers of nearby dwellings and commercial premises.
7.REASON FOR APPROVAL OF THE APPLICATION :-The proposal complies with policies CS7 of the adopted core strategy and the objectives of the NPPF and emerging policy R1 of the Local Plan Part 2.
8.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
