1.The application site is located outside the village development limits and is therefore contrary to saved policy HOU10 from the Borough-Wide Local Plan. There is a lack of safe pedestrian access to local amenities and therefore it is considered that there would be a reliance on the private car for future occupants of the proposed development. As such it would be contrary to core policy CS1 (e) from the adopted Core Strategy, which seeks to ensure that new developments provide easy access for everyone to jobs, shops and community facilities by walking, cycling and public transport. Furthermore, it is considered that the application would not comply with core policy CS02 from the adopted Core Strategy which seeks to balance the delivery of new homes with the creation of self-contained communities and reducing the need to travel.
2.From south of the junction with Market Road running south down Mill Road towards the village proper, the open gaps between the buildings form part of the open and verdant character of the area. Any development in this location would result in the erosion of this character to the detriment of the visual amenity of the area and contrary to Core Policies CS09 G and CS11 which seeks to safeguard and where possible enhance the borough's wider landscape character.
3.No tree report or arboricultural impact assessment has been provided as part of the application. It has therefore not been demonstrated that the oak tree on the eastern boundary of the site would not be harmed by the development. This is contrary to the aims of Core Policies CS09 G and CS11 G from the adopted Core Strategy which seeks to protect the Borough's biodiversity assets.
4.It has not been demonstrated that the 2.4x120 metre visibility splay to the south can be provided whilst still protecting the oak tree to the south of the access. This is contrary to the aims of Core Policy CS16 from the adopted Core Strategy which in part seeks to ensure that new development does not have an adverse impact on the safety and efficiency of the local road network.
5.STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
