No.Condition Text
1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development, including the materials to be used, shall be carried out in strict accordance with the revised plan no.2080-001 Revision D, as received by the Local Planning Authority on 30 April 2021. The reason for the condition is:- For the avoidance of doubt.
3.No development shall take place until there has been submitted to and approved in writing by the Local Planning Authority an Arboricultural Implications Assessment (AIA) comprising Tree Constraints Plan (TCP), Tree Protection Plan (TPP), and Arboricultural Method Statement (AMS) for the development hereby permitted. The development shall be undertaken only in strict accordance with the details of the AIA to be approved, and the AMS therein, and the protection measures for the trees and hedges on site shall be retained as approved for the duration of the construction period. For the avoidance of doubt the AIA shall include indications of all existing trees and hedgerows on the site, and details of protection measures and Construction Exclusion Zones for all trees and hedges, together with measures for their protection during the full course of development. The reason for the condition is:- In the interests of the visual amenities of the locality, to retain protected trees, and to preserve the character and appearance of the conservation area.
4.The existing trees on the site shall not be felled or damaged in any way without the prior consent in writing of the Local Planning Authority. No materials or equipment shall be stored, nor vehicles accessed, nor fires lit, nor excavations undertaken, within the Root Protection Areas unless in accordance with the Arboricultural Method Statement to be approved by the Local Planning Authority under condition 3 of this permission. The reason for the condition is:- In the interests of protecting the existing trees which represent an important visual amenity which the Local Planning Authority consider should be substantially maintained.
5.No work shall commence until the exact appearance and design and materials of the proposed west/front elevation garage door and its materials have first been submitted to and approved by the Local Planning Authority. The development shall only be carried out using the agreed design and materials, which shall be retained as such thereafter. The reason for the condition is :- In the interests of preserving the visual amenities of the area, and protection of the setting of listed buildings and character and appearance of the conservation area.
6.The materials to be used in the construction of the 1.8m-extended driveway frontage to the garage shall match the materials used in the existing driveway, and shall be of permeable construction. The reason for the condition is :- In the interest of the character and amenity of the area in accordance with the Great Yarmouth Borough-Wide Local Plan and in the interests of minimising surface water run-off.
7.The finished floor level of the development hereby permitted shall be no higher than the level of the existing driveway. The reason for the condition is :- In the interests of protecting neighbouring residential amenity.
8.There shall be no use of the garage hereby permitted until a drainage scheme has first been submitted to and approved in writing by the Local Planning Authority. The drainage strategy shall follow the details indicated on approved plan revision D (to use a soakaway no less than 5m from the garage) and shall have regard to the tree protection measures and root protection areas identified by details required for Condition 3 of this permission. For the avoidance of doubt no surface water shall be discharge to the foul sewer. The reason for the condition is:- To avoid drainage runoff affecting neighbouring premises, to protect existing trees, and to overloading the sewerage system and avoid problems of pollution.
9.The garage shall only be used for private domestic use as a garage or workshop space as proposed in submitted drawing Revision D, and only in connection with the dwelling to which it relates. There shall be no use as habitable space and nor shall any business or commercial activity be carried on, within, or from, the garage hereby approved. The reason for this condition is:- In the interests of maintaining the residential amenities of the occupiers of adjacent property and to ensure appropriate provision of parking, turning and manoeuvring space for the dwelling.
10.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
