1. | The development must be begun not later than three years beginning with the date of this permission.
The reason for the condition is:-
Required to be imposed pursuant to Section 51 of the Planning and Compulsory Purchase Act 2004. |
2. | The development shall be carried out in accordance with the application form received by the local planning authority on the 2nd December 2020 and revised plans received by the Local Planning Authority on 6th July 2021, as below. Drawing references:

· Existing Elevation and Floor Plans - P02-Rev A
· Proposed Elevation and Floor Plans - P03-Rev A

3. | There shall be no use nor occupation of the development hereby permitted until a 2.4 metre wide parallel visibility splay (as measured back from the near edge of the adjacent road (Low Road)) has first been provided across the whole of the site's roadside frontage. The splay shall thereafter be maintained at all times free from any obstruction exceeding 0.6 metres above the level of the adjacent road.
The reason for the condition is: -
In the interests of highway safety in accordance with the principles of the NPPF. |
4. | There shall be no use nor occupation of the development hereby permitted until the proposed access, on-site car parking and turning area have first been laid out, demarcated, levelled, surfaced and drained in accordance with the approved plans and these shall be retained thereafter available for that specific use.
The reason for the condition is: -
To ensure the permanent availability of the parking/manoeuvring areas, in the interests of satisfactory development and highway safety. |
5. | The development hereby permitted shall be used for holiday accommodation purposes only.
The reason for the condition is :-
To site is in a location considered to be unsuitable for residential use, being outside defined development limits and constrained by flood risk, and relative inaccessibility, so the restriction is imposed to ensure the holiday unit is not used as permanent residential accommodation. |
6. | The development hereby permitted shall be used for holiday purposes only and shall not be occupied for any more than 28 consecutive days at any one time without the express written permission of the Local Planning Authority.
There shall be no use of the development hereby permitted as either the primary or permanent residential accommodation of any persons at any time.
The reason for the condition is :-
To ensure the holiday unit is not used as permanent residential accommodation. |
7. | The operator of the development hereby permitted shall maintain an up-to-date register of persons occupying the holiday let accommodation at all times, together with the visitors' permanent residential postal address, to be held on site or at other premises agreed in writing by the Local Planning Authority, and shall ensure these details are able to be made available for inspection by the Local Planning Authority at any time during normal working hours.
The reason for the condition is :-
To ensure the holiday unit is not used as permanent residential accommodation. |
8. | No work of construction shall commence until the exact types and colours of the materials to be used in the building's conversion have first been submitted to and approved in writing by the Local Planning Authority. The development shall be carried out using the agreed materials which shall be retained thereafter.
The reason for the condition is :-
In the interests of the visual amenities of the area as precise details of the materials have not been submitted. |
9. | There shall be no use or occupation of the development hereby permitted until a Landscape Plan has first been submitted to and approved in writing by the Local Planning Authority, and such details shall include specifications of all planting, site preparation and tree and hedge retention and protection measures.
The approved details of the Landscape Plan shall be provided no later than the first planting season following commencement of the use, and shall be retained and maintained as such thereafter.
The reason for the condition is :-
In the interests of the visual amenities of the area as precise details of landscaping and proposed planting have not been submitted. |
10. | There shall be no use or occupation of the development hereby permitted until a flood response plan has first been submitted to and approved in writing by the Local Planning Authority. The flood response plan details shall including information regarding the availability of the Environment Agency's Flood Warnings Service and shall be made available to all future occupiers of the site.
The reason for the condition is :-
In accordance with the recommendations of the flood risk assessment, to minimise the risk to the occupants in the event of flooding. |
11. | There shall be no use or occupation of the development hereby permitted until a scheme to mitigate the impacts of dogs has first been submitted to and approved in writing with the Local Planning Authority. The details shall include either: (a) a dog waste bin being provided on site for residents, with disposal management proposals; or, (b) Confirmation that the property is to be let only on the provision that dogs are not allowed, with details of management thereof. The development shall thereafter be operated in accordance with the approved details.
The reason for the condition is :-
To protect the adjoining Natura 2000 sites in accordance with CS11. |
12. | There shall be no use or occupation of the development hereby permitted until a visitor information pack has been prepared for use at the property to include details of alternative walking sites and details about the importance and vulnerabilities of the nearby Natura 2000 sites. The information shall be made available to all visitors to the premises.
The reason for the condition is :-
To protect the Natura 2000 sites in accordance with CS11. |
13. | The operator of the development hereby permitted shall ensure that all guests visiting the holiday accommodation are asked to access the site from the east along Low Road wherever possible, with the express request that visitors avoid access to Low road via Empsoms Loke wherever possible.
The reason for the condition is :-
In the interest of the residential amenities of the occupiers of Empsons Loke and to reduce the occasions where there may be conflict between the users of the public byway and traffic accessing the site via Empsons Loke. |
14. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner. |
