1.The proposal is considered by the Local Planning Authority to be of significant scale and the extension of the dwelling in the manner proposed would cause overshadowing and adversely impact upon the light received by the adjoining dwelling's habitable rooms and amenity space, for what is already a relatively small and shaded dwelling. The proposal would also have an overbearing impact on the outlook and amenity of that adjoining dwelling by virtue of the scale, design and positioning of the proposed extension. Therefore, the proposal is considered contrary to emerging Policy A1 of the Final Draft Local Plan Part 2 which seeks to prevent such adverse impacts, HOU18 of the saved policies from the Great Yarmouth Borough wide local plan (2001) and NPPF paragraph 127 which also seeks to prevent such impacts.
2.The proposal is considered by the Local Planning Authority to create overlooking into the garden of the dwelling at 30 Eastcote and is considered likely to cause a loss of privacy, and so would adversely impact upon the amenity of the neighbouring dwelling, and therefore the proposal is considered contrary to emerging Policy A1 of the Final Draft Local Plan Part 2 which seeks to prevent such adverse impacts. HOU18 of the saved policies from the Great Yarmouth Borough wide local plan (2001) and NPPF paragraph 127 which also seeks to prevent such impacts.
3.The proposal is considered by the Local Planning Authority to not be in keeping with the character and appearance of the Conservation Area, by virtue of the scale and form proposed, creating a disproportionate relationship with dwellings in the vicinity of the site., and causing a detrimental impact on the Conservation Area. In this case there are no public benefits presented which are considered sufficient to outweigh the less than substantial levels of harm caused to the designated heritage asset, and so the proposal remains contrary to both Policy CS10 of the Core Strategy and paragraph 196 of the National Planning Policy Framework.
4.STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
