Great Yarmouth Borough Council Portal
No.Condition Text
1.This land is in an unsustainable and relatively remote location, outside the physical limits defined in policy CS1 and the Emergent Policy in the Local Plan part 2. The Borough has a demonstrable five year housing supply so the tilted balance in the National Planning Policy Framework Paragraph 11d is not triggered, and so this divergence is considered contrary to policy CS1(a) with regard to location of development and CS2(a) and (e) where development should be focussed sequentially to larger settlements and preferably redevelop previously developed land. Development of village periphery sites can increase land hope value and frustrate the delivery of affordable housing on rural exception sites contrary to the tenets of policy CS3.
2.The proposal is sited within the area categorised by DEFRA as good quality Grade 1 agricultural land, but where a professionally prepared study has shown this to be Grade 2 Agricultural land, nevertheless contrary to Great Yarmouth Borough Council Core Strategy policy CS6(j), CS11(j) where the protection and where possible enhancement of the higher quality agricultural land is cited and Policy CS12 (g) Recognising the need to protect the best and most versatile agricultural land (in grades 1, 2 and 3) as a valuable resource for future generations and NPPF paragraph 170(b).
3.No legal agreement to secure the Affordable housing has been completed and as such the Local Planning Authority must withhold its consent in regard to this matter as the proposal does not comply with policy CS03 for affordable housing.
4.NOTES - Please read the following notes carefully:- It is the practice of the authority not to incur costs for both applicant and council if a proposal is considered to warrant refusal. If an appeal is envisaged, you are advised to approach the Local Planning Authority to remove this reason for objection in advance of appeal as the Inspectorate cannot legally enter into planning obligations.
