No.Condition Text
1.The property is located within the Back of the Seafront Improvement Area and emerging policies GY7 and H12 from the final draft LPP2 state that the Council will resist HMOs in this area due to concerns about this type of accommodation having an adverse impact on the character of the area. The proposal is for a 12 bedroom sui generis HMO and this use will not comply with emerging policies GY7 and H12 which encourage uses which will improve the character of this area.
2.Although exceeding the minimum room size for single occupancy (6.5sqm) outlined in the Nationally Described Size Standards and emerging policy H12 from the Final Draft LPP2, some rooms - notably bedrooms 2, 7 and 10 - would be constrained by door openings, access and layout. The result of this would be restricted usable living space. In combination with a lack of measures to mitigate noise in rooms adjacent to communal areas the result is considered to be a proposal which would result in detrimental living condition for occupiers in conflict with Core Policy CS01 e from the adopted Core Strategy and Paragraph 127 F from the NPPF.
3.STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
