1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- Required to be imposed pursuant to Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development hereby permitted shall be carried out in accordance with the submitted application form and drawing number: 1391/5 received on 11 June 2020 and Flood Risk Assessment Report Ref: 2299/RE/06-19/01 Revision B received on 20 July 2020 by the Local Planning Authority and shall be retained in the approved form thereafter. No material variation from these plans shall take place unless otherwise first agreed in writing with the Local Planning Authority. The reason for the condition is :- In order that the development hereby permitted shall be fully implemented in complete accordance with the approved plans and to accord with the Great Yarmouth Borough-Wide Local Plan.
3.Prior to the first occupation and during the construction of the dwellings hereby permitted the flood evacuation plan, prevention and resilience measures submitted in the Flood Risk Assessment Ref: 2299/RE/06-19/01 Revision B received on 20 July 2020 by the Local Planning Authority shall be implemented as follows: 1. ground supported or suspended floors with a damp-proof membrane included within the floor construction and suitable floor finish such as ceramic or concrete based floor tiles. Internal walls shall be prevented from flood damage by fitting flood proof up to the flood level. 2. standard gypsum plasterboard which could be used and removed after a flood event, fittings such as plastic or stainless steel units which are durable and resistance to floodwater 3. raised ground floor electrical sockets above the flood level, insulated wiring for communication cables and non return valves to prevent back flow of flood/foul water. 4. finished ground floor levels should not be lower than 1.12 metres and first floor levels not lower than 3.47 metres AOD. The reason for the condition is :- In the interest of safety from flooding and residential amenities
4.Prior to the first occupation of the development hereby permitted the proposed access/ on-site car parking and turning area shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan and retained thereafter available for that specific use. The reason for the condition is :- To ensure the permanent availability of the parking/manoeuvring areas, in the interest of satisfactory development and highway safety.
5.Notwithstanding the submitted details unless otherwise agreed in writing by the Local Planning Authority the proposed private drive shall be maintained in perpetuity at a minimum width of 4.2 metres for a minimum length of 10 metres as measured from the near edge of the highway carriageway and shall be constructed perpendicular to the highway carriageway for that said distance. The reason for the condition is :- In the interest of highway safety and traffic movement
6.No dwellings/buildings hereby permitted shall be occupied until the remediation works agreed within sections 5.8.2-5.8.4 of the submitted 4D Geo Limited 'Preliminary Risk Assessment Report, Project No. 20-49' for the scheme have been carried out to the satisfaction of the Local Planning Authority. Reason for the condition To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors. (Note: the applicant is strongly advised to contact Environmental Health at an early stage.)
7.In the event that contamination that was not previously identified is found at any time when carrying out the approved development, it must be reported in writing immediately to the Local Planning Authority. All development shall cease and shall not recommence until: 1) a report shall be submitted and agreed in writing by the Local Planning Authority which includes results of an investigation and risk assessment together with proposed remediation scheme to deal with the risk identified and, 2) the agreed remediation scheme has been carried out and a validation report demonstrating its effectiveness has been approved in writing by the Local Planning Authority. Reason for the condition To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors.
8.No deliveries shall be taken at the site outside the following hours:- 08:30 to 18:00 Monday to Friday 09:00 to 13:00 Saturday and no deliveries shall take place on Sundays or Bank Holidays. The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings.
9.Construction work shall not take place outside the following hours:- 08:00 to 18:00 Monday to Friday. 08:30 to 13:30 Saturday No work shall take place on Sundays or Bank Holidays. (These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property). The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings.
10.REASON FOR APPROVAL OF THE APPLICATION :- The proposal meets the aims of Policies CS2, CS3 and CS9 of the adopted Core Strategy (2015) (CS) and saved Policies HOU7 and HOU17 of the Great Yarmouth Borough-Wide Local Plan. The responsibility for the safe development and secure occupancy of the site rests with the developer. The local planning authority has determined the application on the basis of the information available to it, but this does not mean that the land is free from contamination, or that the land could not be declared Contaminated Land in future.
11.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner. It is confirmed that this shadow HRA submitted by the applicant has been assessed as being suitable for the Borough Council as competent authority to use as the HRA record for the determination of the planning application, in accordance with the Conservation of Habitats and Species Regulations 2017. In this instance the Borough Council has considered there is no likely significant effect on protected habitats arising solely from the development itself; and the development would contribute to the overall in-combination significant adverse effect identified by the Habitats Regulations Assessment Report for the Local Plan Core Strategy, but this effect can be adequately mitigated by the Habitats Monitoring and Mitigation Strategy; and that Strategy requires a payment of £110 per each additional dwelling towards the monitoring and mitigation provided through that Strategy.
12.NOTES - Please read the following notes carefully:- The applicant is strongly recommended to advise neighbouring businesses and residential occupiers of the proposals, including any periods of potentially significant disturbance e.g. demolition or piling, together with contact details in the event of problems. The site will potentially generate a significant amount of dust during the construction process; therefore, the following measures should be employed: · An adequate supply of water shall be available for suppressing dust; · Mechanical cutting equipment with integral dust suppression should be used; · There shall be no burning of any materials on site, which should instead be removed by an EA licenced waste carrier, and the waste transfer notes retained as evidence.
