No.Condition Text
.The application site is located outside the village development limits and with the lack of safe pedestrian access to local amenities it is considered that there would be a reliance on the private car for future occupants of the proposed development. As such it would be contrary to core policy CS1 (e) from the adopted Core Strategy, which seeks to ensure that new developments provide easy access for everyone to jobs, shops and community facilities by walking, cycling and public transport. Furthermore, it is considered that the application would not comply with core policy CS02 from the adopted Core Strategy which seeks to balance the delivery of new homes with the creation of self-contained communities and reducing the need to travel.
.The development in this area is scattered and the open gaps between the buildings form part of the open and verdant character of the area. Any development in this location would result in the erosion of this character to the detriment of the visual amenity of the area and contrary to Core Policy CS11 which seeks to safeguard and where possible enhance the borough's wider landscape character.
.The application site is located outside of the development limits and therefore, as per CS02, in the countryside development will be limited to conversions/replacement dwellings/buildings and schemes that help to meet rural needs meaning saved Policy HOU10 shall apply. In the applicant's supporting statement, it notes how the proposed dwelling would help the applicant manage the stable yard and the land to reliably earn an income. However, it has not been demonstrated that: -it is essential in the interests of good agriculture or management that an employee should live on the holding or site rather than in a town or village nearby; -there is no appropriate alternative accommodation existing or with planning permission available either on the holding or site or in the near vicinity; or -the need for the dwelling has received the unequivocal support of a suitably qualified independent appraiser; -the holding or operation is reasonably likely to materialise and is capable of being sustained for a reasonable period of time. Consequently, it is considered that the application is contrary to Saved Policy HOU10. Additionally, Emerging Policy H5 (F) from the draft Local Plan Part 2 requires that "there have been no previous disposals of potentially suitable properties from the holding, or by the applicant or related businesses or persons within the previous 10 years." The applicant's statement confirms that the applicant recently sold Black Barn and therefore the application is contrary to Draft Policy H5 from the Final Draft Local Plan Part 2.
.STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
