1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- Required to be imposed pursuant to Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The change of use and proposed development hereby permitted shall be carried out in accordance with the application form, Design and Access Statement and drawing numbers: HS/20/GH/SC/001, HS/20/GH/SC/002, HS/20/GH/SC/005, HS/20/GH/SC/006, HS/20/GH/SC/007, HS/20/GH/SC/008, HS/20/GH/SC/009, HS/20/GH/SC/010, HS/20/GH/SC/011, HS/20/GH/SC/101, HS/20/GH/SC/102, HS/20/GH/SC/103, HS/20/GH/SC/104, HS/20/GH/SC/105, HS/20/GH/SC/106, HS/20/GH/SC/107, HS/20/GH/SC/108, HS/20/GH/SC/109, HS/20/GH/SC/110 and H/SC/111 received on 22July 2020 by the Local Planning Authority. No variation from the submitted details shall take place unless otherwise first agreed in writing with the Local Planning Authority. The reason for the condition is :- In order that the development hereby permitted shall be fully implemented in complete accordance with the approved plans and to accord with the Great Yarmouth Borough-Wide Local Plan.
3.No work shall commence until details of business operation hours and the proposed use of the building's ground floor have been submitted to and approved by the Local Planning Authority. The development and the operation of the building shall be carried out using the agreed details. The reason for the condition is :- In the interests of the amenities and locality as precise details of the business operation hours and detailed use have not been submitted.
4.Details of the proposed new windows to be provided by the agent/applicant and approved by the Local Planning Authority. The agent/applicant need to ensure that all existing historic single glazed windows are going to be retained. Reason: To ensure that the proposal would not harm the character and appearance of the Conservation area.
5.The position, type and method of all new services and related or other new external appurtenances or alterations, shall be specified and approved by the Local Planning Authority prior to any related works being carried out. Reason: To ensure that the materials and arrangement are appropriate for and don't harm the character and appearance of the Conservation area.
6.Any making good or relative masonry works should be carried out in red bricks and lime mortar. Reason: To ensure that traditional methods and materials are used, and the integrity of the asset is preserved.
7.The proposed use of the first floor of the building hereby permitted shall be used for holiday purposes only. The reason for the condition is :- To ensure the space is not used as permanent residential accommodation.
8.Construction work shall not take place outside the following hours:- 07:30 to 18:00 Monday to Friday 08:30 to 13:30 Saturdays No work on Sunday or Bank Holidays. The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings.
9.REASON FOR APPROVAL OF THE APPLICATION :- The proposal meets the requirements of Policy BNV18 of the adopted Great Yarmouth Borough-wide Local Plan and Policies CS1,CS3,CS9 and CS11 of the Core Strategy (2015) (CS), paragraph 200 of The National Planning Policy Framework (NPPF) and The Planning (Listed Buildings and Conservation Areas) Act 1990 (Section 72).
10.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner. It is confirmed that this shadow HRA submitted by the applicant has been assessed as being suitable for the Borough Council as competent authority to use as the HRA record for the determination of the planning application, in accordance with the Conservation of Habitats and Species Regulations 2017. In this instance the Borough Council has considered there is no likely significant effect on protected habitats arising solely from the development itself; and the development would contribute to the overall in-combination significant adverse effect identified by the Habitats Regulations Assessment Report for the Local Plan Core Strategy, but this effect can be adequately mitigated by the Habitats Monitoring and Mitigation Strategy; and that Strategy requires a payment of £110 per each additional dwelling towards the monitoring and mitigation provided through that Strategy.
