| 1. | The proposed dwelling will be smaller than the other dwellings on the area and it will be situated on a plot that is substantially smaller than the existing nearby dwellings. The resulting size of the dwelling and constrained nature of the plot, combined with the limited provision of outdoor amenity space, is considered to result in a cramped form of development which is out of character with the surrounding dwellings, and one which would provide a substandard level of outside amenity space for future occupiers of the dwelling.
Consequently, the proposed dwelling does not comply with Core Policies CS01A and CS09A from the adopted Core Strategy, nor with saved policies HOU07A and HOU17 from the Borough-Wide Local Plan. |
| 2. | The application is located within the Orange 400m to 2.5km Indicative Habitat Impact Zone and although a shadow HRA has been received, no HMMS payment has been received. As a consequence of this, the Local Planning Authority is unable to be certain that adequate monitoring and mitigation measures can be secured for the additional in-combination impacts that the proposal would have on the Natura2000 network within the Borough. Therefore, the application is contrary to Core Policy CS11 from the Core Strategy. |
| 3. | STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above. |
